PROPOSED IMPOSITION OF CIVIL PENALTIES - $200,000 This is to inform the Commission that a Notice of Violation'and Proposed Imposition of Civil Penalties in the cumulative amount of $200,000 will be issued on or about October 12, 1993 to the Nebraska Public Power District.
This action is based on the violations involved in three separate regulatory concerns which have each been classified at Severity Level III.
The first concern involves a number of corrective action violations which have collectively been categorized as a problem.
The second concern involves a violation for the inoperability of both trains of the containment hydrogen / oxygen analyzer system.
The third and last concern involves a violation for the failure to include required portions of the service water and reactor equipment.

The escalation and mitigation factors of the Enforcement Policy were considered for the $50,000 base civil penalty applicable to each of the concerns.
For the corrective action problem the civil penalty was escalated 50 percent to $75,000 because the NRC identified the violations.
Ti.s civil penalty for the inoperable-hydrogen / oxygen analyzers was also escalated to $75,000 after partially offsetting escalation for NRC identification and multiple opportunities to identify with mitigation for the licensee's corrective actions.
For the failure to have all require piping in the inservice inspection program, a civil penalty of $50,000 was determined to be appropriate after offsetting escalation for NRC identification with mitigation for the licensee's corrective actions.
It should be noted that the licensee has not been specifically informed of the enforcement action.

The licensee has thirty days from the date of the Notice in which:

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
