The Commission

  • discussed two questions that were certified to the Commission by the Appeal Board in the Shoreham proceeding (see ALAB-769).

The Commission requested that the Office of the General Counsel revise the proposed order (attachment to SECY-84-206) as discussed at the meeting.

The Commission agreed to vote by notation on the proposed order and to schedule this item for affirmation as soon as possible, hopefully late this week.

(Subsequently, OGC informed SECY that a revised draf t order would be submitted to the Commission in the form of a SECY

Accordingly, the Office of the Secretary will provide affirmation vote sheets when this paper is received.)

At the February 3,1984 neeting between the Advisory Panel for the Oecon-tanination of Three f tile Island and the Connission, you recuested a status recort on tne NRC's staff review of the Office of Investigations (0I) interin report on the Three Mile Island Unit 2 (TMI-2) allegations.

I told you at that time that the Connission nad the staff's assessnent under review anc hoped to release the recort in the near future.

In ycur letter of Pay 9,1984, wnich provided your suggested discussion itens for the u;:cening l'ay 30, 1904 Advisory Panel - Ccnnission Meeting here in Washington, D.C., you again incuired about the status of tne 1RC's staff review and res::ense to the OI interin report.

Since you and the Advisory Panel have excressed continuing 1 erest in this subject, I an providing ycu with cocies (Enclosures 1 througn of all the recent recorts related to :ne NRC's investigation of allegations regarding administrative deficiencies in the cleanup of Three Mile Island Unit 2 (TMI-2).

As you are aware, the NRC Office of Investigations (OI) c ncleted its interin recor: on tne cleanuo allegations on Sectember 1,1983.

Mayor Arthur E. Morris the issues raised in 0I's turch 2,1984 memorandum and provides the agreement reached between the OI technical team and the Three tile Island Program Office staff on the safety significance of the administrative deficiencies identified by 01 in the T?t -2 cleanup.

The Commission is satisfied that the January 25, 1984 staff ecort, action plan and enforcement action aapropriately address the proble s identified by the OI investigation.

No further action on these matters is deemed necessary.

Furthermore, the Ccenission is confident that with continuing regulatory oversight, which the agency is committed to provide, the cleanuo at IMI-2 can proceed in a safe manner.
