n-c MEMORANDUM FOR:
Chairman Palladino FROM:
Martin G. Malsch.
Deputy General Counsel
SUBJECT:
FOLLOWUP TO TELEPHONE CALL FROM SECRE-TARY HODEL This is a followup to your April 27, 1984 memorandum for the other Commissioners regarding a telephone call from Secre-tary Hodel relating to Judg'e Johnson's decision in Shoreham.
On May 3, I answered a call from an individual in DOE who identified himself as a special assistant to Steve Greenleigh in the DOE General Counsel's office.
I did not know the purpose of the call when I received it.
The individual stated that the DOE General Counsel had asked DOE' OGC to begin preparations with a view toward their possible intervention in the Shoreham District Court case.
I informed him that the Licensing Board's scheduling order, which was at the heart of the litigation, had been vacated by the Commission and.'that the case would in all likelihood be dismissed in the next few days.
I also informed him that the matter had been set down for oral argument before the Commission on Monday, May 7, 1984.
He thanked me for the information.
