-V0GTLE ELECTRIC GENERATING PLANT - PAYMENT OF CIVIL PENALTY ASSOCIATED WITH MODIFIED NOTICE OF VIOLATION (EA 93-304)
Dear Mr. 11cCoy:
This will acknowledge receipt of your letter dated March 1,1995 and Georgia Power Compan.v's (GPC) check for $200,000 in payment for the civil penalty proposed by NRC in a letter and tiodified Notice of Violation (NOV) issued on February 13, 1995.
In your letter, you point out that restated. Violation C.3 in the Modified NOV
" refers mistakenly to the 'Vogtle Plant General Manager' as failing to clarify and verify the starting point for the count for (certain] diesel generator starts" and that the correct reference should be to the " Acting Assistant General Manager-Plant Support, rather than the Plant General Manager." The Staff Re' view Group evaluated a similar comment in GPC's Reply to the May 9, 1994 Notice of Violation and agreed that the correct reference should be to the Acting Assistant General Manager-Plant Support'.
Based on the Staff Review Group's evaluation, the NRC staff agrees and hereby corrects Violation.C.3 to to read, in pertinent part:

... Second, the Actina-Assistant General Manaaer-Plant Suonort, the General Manager'for Plant Support and the Technical Support Manager failed to clarify and verify the starting point for the count of i
successful consecutive DG starts reported in the April 19, 1990 LER....
No additional response to the Modified NOV is required, and this letter will serve to close this enforcement action.
