SUBJECT:

TELEPHONE CALL WITH MR. HAIRSTON, EXECUTIVE VICE PRESIDENT GEORGIA POWER COMPANY On August 4, 1994 a telephone conversation was conducted between Mr. Hairston and Mr. Taylor concerning the signature block on the Georgia Power Company's July 31, 1994 response to the enforcement

' action issued to it on May 9, 1994. Messrs. Milhoan, Lieberman and Gray joined th'e call a few minutes after it started and Mr.

Chandler' joined the call a few minutes later.

The call was generated as a result of a previous call on July 29, 1994 between Mr. Hairston and Mr. Taylor wherein Mr. Hairston had informed Mr. Taylor that Georgia Power Company intended Mr. McCoy to respond for the company. Mr. Taylor responded that the enforcement action was a significtnt ratter and that it should be given consideration at the highret lew ls within the company but who signed the letter was up to the cc apany to decide.

Unknown to Mr. Taylor was that during a deposition of Mr.

Hairston on July 27,1994, the issue of who would sign the response was discussed on the record between Mr. Hairston and the intervenor's counsel. In addition the NRC counsel had stated, also on the record, that the enforcement action had been sent to Mr. Franklin and it would seem appropriate for him to sign out the response. Apparantly because of this controversy, Mr. .

Hairston called Mr. Taylor on July 29, 1994. After the response f was received, Georgia Power's counsel informed NRC counsel that Mr. Taylor had been contacted by Mr. Hairston concerning the _

person who would sign the letter.  !

l The August 4, 1994 call was for the purpose to clarify chat Mr. l Taylor had not said to Mr. Hairston that Mr. McCoy's signature I was acceptable and that he was not aware that this matter had been discussed on the record in a deposition. Mr. Hairston stated that he agreed that Taylor had only said it was the licensee's responsibility to decide who would sign the letter.

He also apologized that he did not tell Mr. Taylor about the discussion with the intervenor's counsel.

The call was closed by Mr. Hairston stating that he would make sure that his lawyers knew that Mr. Taylor had not stated that Mr. McCoy was the appropriate person to sign the letter and if necessary would have that' stated on the deposition record.
