VOGTLE ELECTRIC GENERATING PLANT ,

PAYMENT OF CIVIL PENALTY ASSOCIATED WITH ,

MODIFIED NOTICE OF VIOLATION (EA-93-304)

Pursuant to the modified notice of violation and proposed imposition of civil penalties referenced above, Georgia Power Company (GPC) submits the enclosed check in the amount of $200,000. for payment of the civil penalty as provided for in your letter dated February 13,1995. With the payment of this civil penalty this enforcement action is fully resolved. ]

Since GPC has previously responded under the requirements of 10 CFR 2.201 to the original Notice of Violation, dated May 9,1994, GPC is not required nor will submit a  ;

written response to this modified notice of violation. Accordingly we make only one observation. The restated Violation C.3 in the Modified NOV refers mistakenly to the "Vogtle Plant General Manager" as failing to clarify and verify the starting point for the l count for successful consecutive diesel generator starts. We continue to believe this  ;

Violation should refer to the Acting Assistant General Manager - Plant Support, rather than the Plant General Manac Please see footnote 21 on page 32 of our Reply to Notice of Violation. As stated e ae NRC's transmittalletter ofMay 9,1994:
