Reply to Notice of Violation and Proposed Imposition of Civil '

Penalty (NRC Inspection Report 50-285/89-31)

Omaha- Public Power District (OPPD) received the Notice of Violation and Proposed Imposition of Civil Penalty dated November 13, 1989. The Notice of Violation cited-violations concerning-inadequate protection of Safeguards .

Information,. inadequate searches and inadequate measures taken to compensate for components of the security system that were not functioning. A $25,000 civil penalty has been proposed for the inadequate protection of safeguards Q e .#

g penalty. Accordingly, please find attached OPPD's response to the violations eso pursuant to 10CFR Part 2.201 and a check in the amount of $25,000.

po M NRC expressed concern in the cover letter of Reference 2, involving the

.possible need for a more-general approach to corrective action regarding the

'em y -g search process. To ensure that the search process is carried out properly the Nuclear Security Training Staff in conjunction with the Fort Calhoun Nuclear

%p Training Department prepared a video presentation which addressed in detail the

fg regulatory and procedural requirements for searching vehicles and materials.

This video presentation was presented to the Security Force in the form of remedial training.

- Also, in an effort to identify weaknesses in the security program, the Nuclear Security Operations Supervisor instituted a Task Performance Appraisal System.

! A Task Performance Appraisal Form is now being utilized by Shift Security Supervisors and Shift Sergeants to document and observe specific job task performances by security personnel, including search techniques. The attached  ;

violation response provides additional information regarding OPPD's corrective actions.

The Security Force is currently in a twelve hour shift configuration in support of the ongoing security systems upgrade project. In consideration of the twelve hour shifts and the potential impact they have on Security Force personnel, the Shift Security Supervisor's responsibility to evaluate a security officer's condition prior to assigning the officer to his/her duties has been reemphasized. Also, in the effort to preclude recurrence of guard inattentiveness incidents the security management of Fort Calhoun Station has

- established and will continue to support a policy of relief without recrimination. This policy reflects OPPD's efforts and commitment to implement a first-rate security program and maintain an alert and effective-Security Force at Fort Calhoun Station.-

The violations cited in Reference 2 are largely attributable to personnel

error. Our response to these violations discusses program changes OPPD has implemented to reduce the probability of such personnel error in the future and- '

thereby prevent recurrence of such violations.
