5-1. Identify every occasion on which TMIA contends that Met-Ed " negligently ,

TMIA's Response 5-1(a) . TMIA has relied on licensee's determination of what is "necessary maintenance and repair" in the form of the priority assigned to corrective mainte- 9 0

nance problems. Daniel Shovlin's letter to G. P. Miller dated November 30, 1979, concerning the " Priority System" summarizes Priority 1, 2 and 3 as follows:
- a. Priority 1 -
A. Can only be classified by superintendents, department heads or shif t supervisors; will cause a plant shutdown; reduce generation; has a time clock of very short duration; is an immediate industrial or nuclear safety hazard; compromises nuclear safety, reactor control or power conversion cycle control system insofar as to present a clear threst of initiation of a trip or severe transient; imposes or threatens increased personnel radiation exposure; constitutes one element of a multievent failure which would result in initiation of a trip or transient. Reason for the priority shall be included in the description portion of the work request.
B. Maintenance personnel will be expected to work immediately and the procedure (if necessary) will be hand-carried or telephoned through the approval circuit.
C. This level would definitely be carried on the Dully Work List.
D. Continuous maintenance effort, including overtime as neces-sary, to provide effective timely resolution of the problem is mandatory .
E. Operations personnel will be expected to arrange the want to a condition to allow work; switching and tagging for this job will take priority over all other requests for switching and tagging ,
- b. Priority 2 -
A. Could cause a plant shutdown if operation is continued too long; redundant component and backup is no Icnger available; could cause a plant limitation in the near future; time clock on the component that will require it to be repaired in a timely fashion; items that should be repaired when plant conditions allow. Reason for priority shall be incluced in the description portion of the work request.
B. Maintenance personnel will be required to respond within a
, reasonable time that'will allow proper planning and scheduling, repair time should not normally exceed two work weeks or the time necessary to meet the most limiting condition.
C. Should be carried on-Daily Work List if certain plant conditions, time frames or support from other departments must be identified.
D. Overtime could be authorized if necessary.
- c. Priority 3 -
A. Routine corrective maintenance that does not impact plant

operation.
B. Work should be done during normal work hours usually com-pleted within a reasonable time period such as a month.
C. Could be placed on the Supplemental Work List if more than one department is concerned or a certain plant condition is necessary for h to be done.
The priority system is further explained in licensee's Administrative Procedures 1026. 1407-1, a letter from R. E. Sieg11tz dated February 5,1980, concerning " Job Ticket Priority", Daniel Shovlin's deposition of February 25, 1980, and Douglas Weaver's deposition of February 22, 1980.
5-1(b) & (c) . Once a " Generation Corrective Maintenance System Job Ticket (Work Request) -- Three Mile (" Job Ticket")"; hereafter work request, was identified as representing "necessary maintenance and repair", the work request was exadined for extraordinary time differential frem the date of origination to the date of completion. Time lags of approximately one year or more for Priority 1 and 2 items represent " deferred" maintenance.
Attachment "A" represents the first installment of work requests that TMIA has identified as meeting the above criteria. These work requests will be relied on by TMIA in proving that Met-Ed has negligently, and on occasion, will-fully violated NRC regulations concerning the safe operation of both Units #1 and
- 2, in that it has deferred necessary maintenance and repairs in order to minimize reactor downtime, to the detriment of the integrity of the nuclear faci" / itself.

TMIA's Response 5-3 (a) . See response to 5-1(a) .
5-3(b) & (c) . Using the analysis explained in response to 5-1(b) & (c), TMIA will rely on the work requests contained in Attachment "A" to proye that (t) he licensee has, in the past, allowed work orders to go undone in order to avoid shutting Unit #1 down to perform necessary maintenance.
Interrogatory 5-4 5-4. Identify every occasion on which TMIA contends that Met-Ed " allow (ed) work orders to pile up until refueling, at which time the licensee would attempt to do all the work required."
- a. Set forth each and every fact and the source of each and every fact upon which the allegatien is based,
- b. Identify all documents, including Job Tickets, containing any evidence or informatier relied upon by TMIA in support cf the allegation.
- c. :dentify all persons having any information or knowledge relied upon by TMIA in support of the allegation.

TMIA's Response 5-4(a) & (b) . Using the analysis explained in response to 5-1(b) & (c), (IA will rely on the work requests contained in Attachment "A" to prove that (t)he licensee would allow work orders to pile up until refueling, at which time the licensee would attempt to do all the work required.
