On November 27, I wrote the Licensin; 3 card cen-cerning :he hearing schedule for the December hearin;s in this case. Counsel for the parties have conferred further with respe:: to the hearing schedule and the schedula has been altered in,the following sanner:

a. Completion of the ECCS issues, i.e.,

Questions 2-1, 2-2 anu 2-3. This iten remains unchanged. Applicants intend to offer Mr. Levine's rebu::al testimony, Amendment 13 anc page 3.3-45c of Amendmen: 12 in:a evidence at the close of Intervenor's direct case on Questions 2-1, 2-2 an. 2-3.

b. Post Accident Monitoring, i.e., Question 13-1. This item has been inserted ahead of fire protection in order to facilitate Intervenors' counsel's schecule with respect to other pressing legal matters.
c. Fire Protection, i.e., Contentions 7, 3 and 9. This item will commence no earlier than Thursday morning, December 7.
d. ATWS, i.e., Contention 67.
e. Completion of QA - Special Processes, i.e., Question 10-4 Intervenors' counsel has advised that MH3 Tech-nical Associates will not be available after December 12, 1973. It is my understanding that the Licensing 30ard ruled during the most recent conference call that it eculd not require the Intervenors to proceed without their tech-nical consultants. Based on this understanding, it would appear that after oral argument on the 13th the only issue that can be litigated is the completion of Question 10-4 Applicants request that this issue be taken up on the morn-ing of December 14 rather than the afternoon of December 13.

As the Licensing Board knows, new witnesses, Messrs. Gang and Marquis, will be adopting the previous testimony of Mr. Long. Under these circumstances, prepara:Lon time vill be longer than usual and the best time to consult with coun-sel is December 13. Accordingly, we reques: that Question 10-4 be scheduled for the morning of December 14 Counsel for Intervenors has no objection to this request. I havs been unable to reach counsel for the :i F.C 5:aff today; how-ever, I will continue my efforts to determine if counsel has any objection to the request.
