SUBJECT:
DISCUSSION OF PROCEDURES FOR COMMISSION REVIEW OF LICENSE APPLICATIONS AND INTERIM STATEMENT ON LICENSING (See 9/24/79'& 9/26/79 OGC memoranda), 2:25 P.M.,
T}iURSDAY, OCTOBER 4,1979, COMMISSIONERS' CONFERENCE ROOM, D. C. OFFICE (OPEN TO PUBLIC ATTENDANCE)
The Comission, by a vote of 5-0, approved the interim policy statement on licensing as described in the 9/24/79 OGC memorandum, and requested that:
Ti (1) no new licenses be issued without Commission action; (2) no decisions authorizing license issuance be issued; (3) partial initial and appellate decisions continue to be issued; (4) staff should, in those la cases it feels prepared, proceed with licensing reviews and presentation of evidence before Boards in licensing hearings; and (5) petitions received from various applicants requesting their proceedings to resume be controlled by this statement.
(Subsequently, the policy statement was signed by the Secretary on October 4, 1979).
In taking this action, the Commission requested that the General Counsel prep;re for their review and comment a draft final policy statement on Comi:.sion participation in license issuance, as outlined in their discussion.

e The Commission requested:

that OGC draft a Notice of Hearing for Commission review, laying out the scope of the proceeding along the lines of 2 and 3 above; (0GC/0PE) 6.
that the staff transmit through the Department of State to the Philippines P.egulatory Agency the allegations brought to the attention of the Commission on the reactor for export to the Philippines; (IP) 7.
that OGC and ELD examine whether referral of these allegations to the Department of Justice is warranted, and if it is, that these allegations be transmitted to 0IA for referral to the Department of Justice.
