REVISION OF SCHEDULE FOR THE CONDUCT OF ENVIRONMENTAL REVIEW OF THE SOUTH TEXAS PROJECT LICENSE RENEWAL APPLICATION (TAC NOS. ME5122, ME5123, ME4938, AND ME4939)

Dear Mr. Rencurrel:

By letter dated October 25, 2010, STP Nuclear Operating Company (the applicant) submitted an application pursuant to Title 10 of the Code of Federal Regulations Part 54 (10 CFR Part 54), to renew operating licenses NPF-76 and NPF-80 for the South Texas Project (STP), Units 1 and 2, for review by the U.S. Nuclear Regulatory Commission (NRC or the staff). This letter is to inform you about a schedule change in the STP license renewal review.

Related to a recent United States Court of Appeals for the District of Columbia Circuit decision on the NRC waste confidence rule update (10 CFR Part 51.23), additional time is needed to allow the staff to determine the impacts of the decision on the ongoing STP license renewal environmental review. Hence, until the staff completes this determination, the license renewal schedule is to be determined (TBD). The staff will keep you informed of any changes to this development.

Enclosed is a revised schedule for the review of the STP license renewal application. The schedule has been updated to reflect a change in the date (Le., TBD) for the issuance of the Draft Supplemental Environmental Impact Statement and the subsequent environmental review milestones.
