Dear Ms. Shapiro:
On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your lettersdated June 22 and 29, 2007, regarding the license renewal application (LRA) for Indian Point Nuclear Generating Unit Nos. 2 and 3, submitted by Entergy Nuclear Operations, Inc. on April 23, 2007. In your letters, you requested that the NRC extend or delay the period in which interveners may submit requests for hearings for an additional 60 days. You also requested that the NRC provide to you a specific list of documents and other material that were incorporated by reference in the LRA or that otherwise relates to the Indian Point facility.
Additionally, you requested that any and all meetings regarding the relicensing process take place in Westchester County in proximity of the plant.The Commission has considered the appropriate length of time to provide for potentialinterveners to prepare for involvement in the adjudicatory process, when it amended the regulations governing hearing requests, petitions to intervene, and contentions, in Section 2.309 of Title 10 of the Code of Federal Regulations (10 CFR 2.309).
See Statement ofConsideration, "Changes to Adjudicatory Process" (69 FR 2181). Specifically, as adopted, 10 CFR 2.309(b)(3) states that, for proceedings in which a Federal Register (FR) notice ofhearing or notice of agency action is published, a hearing request and/or petition and proposed contentions must be filed within 60 days following the date of publication of the notice (or as otherwise indicated in the notice). The Commission specifically provided a 60-day period, to ensure that sufficient time is available for the filing of requests for hearing/petitions to intervene and contentions. The Commission concluded that this 60-day period, in conjunction with the agency's public notice provisions, "will provide more than ample time for a potential requestor/intervener to review the application, prepare a filing on standing, and develop proposed contentions and references to materials in support of the contentions" (69 FR 2199). With regard to your request that the NRC provide to you a specific list of documents andmaterial incorporated by reference in the LRA or that otherwise relates to the Indian Point facility, available resources do not permit the NRC staff to research and assemble the numerous documents you have requested. However, the NRC staff has made available to the public correspondence, regulatory requirements, and other documents related to the LRA or Indian Point. Publicly available documents are placed in the NRC's Public Document Room in Rockville, Maryland, and can be accessed through the Electronic Reading Room. Members of the public may access the Electronic Reading Room libraries from computers with Internet access by going to http://www.nrc.gov/reading-rm/pdr.html. The ADAMS Electronic ReadingRoom is accessible from the NRC's Web site at http://www.nrc.gov/reading-rm/adams.html. Persons who do not have access to ADAMS, or who encounter problems in accessing the documents located in ADAMS, should contact the NRC's PDR Reference staff at 1-800-397-4209, or 301-415-4737, or by e-mail at pdr@nrc.gov.

If an adjudicatory proceeding is held, the Atomic Safety and Licensing Board (ASLB) would determine the location(s) for its proceedings, which are also generally held in the vicinity of the facility.
