Dear Dr. Pao-Tsin Kuo:
After many years of preparation, Entergy submitted its license renewal application for Indian Point 2 and 3 on or about April 30th, 2007. The timing of the application submission indicates a purposeful attempt by the applicant (Entergy) to reduce, abrogate and inequitably interfere with Stakeholders' ability to Intervene and participate in the relicensing process in a meaningful manner.If the NRC accepts the application on or about July 1, then Stakeholders only have 60 days to file Intervener petition.
Because that time falls squarely in the middle of the summer, many citizen Stakeholders, elected officials and government bodies are on summer vacation and/or short staffed because of vacation schedules.
In fact many courts, businesses, and attorneys throughout the country take time off in August.Therefore, we respectfully submit that the NRC exhibit evenhandedness, fairness and equitable impartiality, by either extending the period in which Interveners may submit petitions for an additional 60 days, or in the alternative the NRC can delay acceptance of the application for an additional 60 days.
A few more months of processing the license application will not harm the licensee in any meaningful way, as the process is expected to take between 2-3 years. Therefore we respectfully request that in the event the NRC accepts the licensee's application that the period for Intervener petition submission be 120 days, In addition, the Relicense Application incorporates by reference a variety of materials, including but not limited to, documents, studies, charts, maps, etc., which have not been made available to the Stakeholder communities.
Many of the reference materials need special computer programs to download from ADAMS, and therefore are inaccessible to community Stakeholders.
Therefore, until such time that ANY and ALL such materials that are incorporated by reference in the Relicense Application, including but not limited to, documents, studies, charts, maps, etc, are made available in a public place, such as a library, within the Stakeholder community, the NRC cannot start the Intervener petition clock. Therefore, we respectfully.
