FERMI 2 - CORRECTION TO AMENDMENT NO. 163 TECHNICAL SPECIFICATION CHANGE REGARDING INCREASED FLEXIBILITY IN MODE CHANGES (TAC NO. MC3089)

Dear Mr. OConnor:

On November 29, 2004, the U. S. Nuclear Regulatory Commission (NRC) issued Amendment No. 163 to Facility Operating License No. NPF-43 for Fermi 2 to change the Technical Specifications (TSs) in response to your application dated April 1, 2004. The changes revised the TSs to adopt the provisions of the Technical Specification Task Force (TSTF) change TSTF-359, regarding increased flexibility in mode changes.

The purpose of this letter is to correct two (2) errors on TS Page 3.0-5, which was issued in Amendment No. 163. This correction letter is consistent with your April 1, 2004, application and the NRC staffs intent. Enclosure 2 of your April 1, 2004, application provides marked-up TS pages that correctly show the proposed changes using wording that is consistent with TSTF-359. Enclosure 3 of your April 1, 2004, application, which provides the proposed revised re-typed TS pages, including TS Page 3.0-5 that contained the two (2) errors.

The first error occurs in the first sentence of TS surveillance requirement (SR) 3.0.4, which should have used the word only instead of the word not as shown in the following sentence:

Entry into a MODE or other specified condition in the Applicability of an LCO shall not only be made when the LCO's Surveillances have been met within their specified Frequency, except as provided by SR 3.0.3.

Additionally, the last sentence of TS SR 3.0.4, should have capitalized the entire word Actions as shown in the following sentence:

This provision shall not prevent entry into MODES or other specified conditions in the Applicability that are required to comply with Actions ACTIONS or that are part of a shutdown of the unit.

W. OConnor, Jr. Enclosed is corrected TS Page 3.0-5, which reflects these corrections. Please replace TS Page 3.0-5 that was issued with Amendment No. 163 with the enclosed corrected page.
