LIC-07-0017 Attachment Page 3 I. MANAGEMENT ACTIONS A. One contractor employee refused a random drug/alcohol test. The individual was denied unescorted access and returned to his employer.

B. Two contractor employees refused a pre-access test. Both individuals initially provided specimens that were out of the required temperature range. One individual refused to provide a second specimen and the other refused to provide a sufficient amount (under direct observation). These individuals were denied unescorted access and returned to their employers.

One contractor employee tested positive for alcohol on a follow-up test (the contractor employee was placed in the follow up program by another utility). After the breath alcohol test was confirmed on a different type of testing equipment (Intoxilyzer 5000), the employee was offered an opportunity to have his blood drawn and elected to do so. The employee was denied unescorted access and returned to his employer. Upon receipt of the specimen, the laboratory found that the seal was not affixed and refused to test it. The Medical Review Officer reported the result as a positive based on the breath alcohol tests; the employee appealed, and a hearing was held. The internal management review concluded that since the final confirmation test was not completed due to a fatal error (unsealed specimen), the test would be deemed not to exist and the test results were removed fiom the record. Personnel associated with the collection of specimens were informed of this error and actions to prevent recurrence were established.

D. One OPPD employee tested positive for cocaine on a random test. The employee was suspended, complied with Employee Assistance Program (EAP) initial procedures, signed a Re-Entry Agreement and returned to work.

E. One OPPD employee tested in the range of 0.02% to 0.04% Blood Alcohol Concentration (BAC) on a random test. Although not considered a positive test, per OPPD procedures, the individual was referred to the EAP for a Chemical Dependency Evaluation. The EAP had some recommendations, which the individual agreed to complete.

F. Four contractor employees tested positive for marijuana on pre-access tests. The individuals were denied unescorted access and returned to their employers.

G. One contractor employee tested positive for marijuana on a random test. The individual's unescorted access was revoked and he returned to his employer.

H. One contractor employee tested positive for alcohol on a pre-access test. The individual was denied unescorted access and returned to his employer.
