This application for an amendment to the James A. FitzPatrick Technical Specifications proposes to eliminate the reactor scram and Main Steam Isolation Valve closure requirements  ;

associated with the Main Steam Une Radiation Monitors (MSLRM). The change is in -

accordance with Ucensing Topical Report NEDO-31400 (Reference 1), as approved in an 3 NRC Safety Evaluation Report (Reference 2). t The FitzPatrick plant has experienced spurious trips of the MSLRM channels on numerous occasions in the past. Failure of one of the MSLRM was a contributing factor to an automatic reactor scram on May 25,1993. This event is described in LER 93-013. The Authority requests expeditious review of this application in the interest of eliminating a potential source of spurious reactor transients, The signed original of the Application for Amendment to Operating Ucense is enclosed for filing. Attachments I, !!,111 to this application contain the proposed changes to the Technical Specifications, the associated Safety Evaluation, and a markup of the affected Technical Specification pages.

A copy of this application and the associated attachments is being provided to the designated New York State official in accordance with 10 CFR 50.91.
