TVA has made commitments to take corrective action in areas where problems l have been identified. The largest task facing TVA is review and revision d' of all normal and emergency operating instructions.

I expect it will be I April before TVA has the operational instructions all rev'iewed, revised, [ and approved.

I There were no items of direct safety concern identified during this o inspection.

I recommend that TVA's commitment to review and upgrade !' a'll emergency operating instructions, as discussed in the management interview'section of the inspection report, be identifica in the Jetter to the licensee.

Peery 2)$/73 Date Inspector's Evaluation (continue on attached sheet, if necessary) This was an inspection of emergency planning preparations, health physics procedures and facilities, and process and area radiation monitoring systems.

! l A great deal of inspection effort remains in the areas of radioactive waste ' disposal, process and effluent monitors, waste sample analysis with some additional effort on health physics procedures and emergency planning.

It is expected that about two additional inspections will be required to resolve incomplete items.

The results supervisor is responsible for obtaining and analyzing all samples of radioactive effluent. At the time of the last health physics inspection (June 1972), he had not completed procedures in this. area buy stated they had just been assigned for writing. Review o*f these and analysis capability will , require considerable effort on subsequent inspections.

In the time available, it was pointed out to the results supervisor that the above areas would be inspected on a subsequent inspection. A significant amount of inspection time will be required on process and effluent monitors, health physics procedures andemergencyplanning,butnotasmuchinspectiontimeasyiffpgrpquiredfor (AAdd W

AN ACT To establish the State Board of Health as the state radiation control agency for regulating, licensing and inspecting sources and uses-of radioactive materials and machines and devices producing tonizing radiation; to authorize the agency to promulgate rules and regulations and prescribe registration, license, and inspection regulations to regulate such materials, machines and devices; to authorize such agency to cooper-ate and enter into agreement with other agencies of this State, the Federal Government, interstate and state agencies, and groups con-cerned with control of such materials, machmes and devices; to em-power the agency to accept and administer loans, grants or other funds in furtherance of its functions, and to conduct training or research relative to control of sources of ionizing radiation; to provide for the appointment of a Radiation Advisory Board to review and evaluate policiqs and programs relative to ionizing radiation and to advise the said agency on any matter cominc before said agency; Federal Govern-to authorize the Governor to enter into certain agreements with the ment; to rovide an opportunity for hearings and judicial review by persons ected by agency orders, rules, or actions; to provide for en-forcement of this Act; to prohibit certain acts relative to any source of ionizing radiation; to prescribe peralties for violation of this Act to repeal conflicting laws; to provide for the effective date of this Act; and to provide an appropriation for carrying out the purposes of this Act.

Be It Enacted by the Legislature of Alabama: Section 1.

Declaration of Policy.

It is the policy of the State of Alabama in furtherance of its responsibility to protect the public health and safety: (1) to institute and maintain a regulatory program for sources of ionizing radiation so as to provide for (a) compati-bility with the standards and regulatory programs of the Federal Government, (b) a single, effective system of regulation within the state, and (c) a system consonant insofar as possible with those of other states; and (2) to institute and maintain a program to permit develop-ment and utilization of source's of ionizing radiatlon for peaceful purposes consistent with the health and safety of the public.

Section 2.

Purpose. It is the purpose of this Act to effectuate the policies set forth in Section 1 by providing for: b g/O _.

(1) a program of effective regulation of sources of ionizing radiation and machines and devices producing ionizing radiation for the protection of the occupational and public health and safety; (2) a program to promote an orderly regulatory pattern within the state, among the states and between the Federal Government and the state and facilitate intergovernmental co-operation with respect to use and regulation of sources of ioniz-ing radiation to the end that duplication of regulation may be minimized; (3) a program to establish procedures for assumption and performance of certain regulatory responsibilities with respect to byproduct, source and special nuclear materials; and (4) a program to permit maximum utilization of sources of ionizing radiation consistent with the health and safety of the public.

Section 3.

Definitions. (a) Byproduct material means any radioactive material (except special auclear material) yielded in or made radioactive by exposure to the radiation incident to the process of producing or utilizing special nuclear material.

(b) Ionizing radiation means gamma rays and X-rays; alpha and beta particles, high-speed electrons, neutrons, protons, and other nuclear particles; but not sound or radio waves, or visible, infrared, or ultra-violet light.

(c) License--General and Specific (1) General License means a license effective, pursuant to regulations promulgated by the state radiation control agency, without the filing of an application to transfer, acquire, own, possess or use radiation producing machines or quantities of, or devices or equipment utilizing byproduct, source, special nuclear materials, or other radioactive material occurring naturally ~or produced artificially.

(2) Specific License means a license, issued after application, to use, manufacture, produce, transfer, receive, acquire, own or possess radiation producing machines or quantities of, or devices or equipment utilizing byproduct, source, special nuclear ma-terials, or other radioactive material occurring naturally or produced artificially.

(d) Person means any indtvidual, corporation, partnership, firm, association, trust, estate, public or private institution, group, agency, political subdivision of this state, any other state or political subdivision or agency thereof, and any legal successor, - . !

representative, agent, or agency of the foregoing, ather than the United States Atomic Energy Commission, or any successor thereto, and other than Federal Government agencies licensed by the United States Atomic Energy Commission, or any suc-(e) Source material means (1) uranium, thorium, or any \\ other material which the Governor declares by order to be source material after the United States Atomic Energy Commission, or

any successor thereto, has determined the material to be such; h or (2) ores containing one or more of the foregoing materials, in such concentration as the Governor declares by order to be source material after the United States Atomic Energy Commis-sion, or any successor thereto, has determined the material in such concentration to be source material.

(f) Special nuclear material means (1) plutonium, uranium 233, uranium enriched in the isotope 233 or in the isotope 235, and any other material which the Governor declares by order to be special nuclear material after the United States Atomic Energy Commission, or any successor thereto, has determined the material to be such,- but does not include source material; or b(2) any material artificially enriched by any of the foregoing, ut does not include source material.

Section 4.

State Radiation Control Agency. (a) The State - ' Board of Health is hereby designated as the State Radiation Control Agency, hereinaf ter referred to as the Agency.

(b) The State Health Officer shall be Director of the Agency, hereinater referred to as the Director, who shall perforra the functions vested in the Agency pursuant to the provisians :I this Act.

(c) In accordance with the laws of the state, the Agency may employ, compensate, and prescribo the powers and duties .of such personnel as may be necessary to carry out the provisions . of this Act.

(d) The Agency shall for the protection of the public health and safety: , (1) Develop and conduct programs for evaluation of hazards associated with use of sources of ionizing radiation; (2) Develop programs with due regard for c.ompatibility with Federal programs for regulation of byproduct, source, and special nuclear materials; (3) Formulate, adopt, promulgate, and repeal codes, rules, and regulations relating to control.of sources of ionizing radia.

tion with due regard for compatibility with the regulatory programs of the Federal Government; (4) Issue such orders or modifications thereof as may be necessary in connection with proceedings under Section 6 of this Act; Advise, consult, and cooperate with other agencies of (5) the state, the Federal Government, other states and interstate agencies, political subdivisions, and with groups concerned with control of sources of ionizing radiation; l' (6) Have the authority to accept and administer loans, grants i-or other funds or gifts, conditional or otherwise, in furtherance of its functions, from the Federal Government and from other sources, public cr private; (7) Encourage, participate in, or conduct studies, investiga-tions, training, research, and demonstrations relating to control of sources of ionizing radiation; and (8) Collect and disseminate information relating to control of sources of ionizing radiation, including: maintenance of a file of all license applications, issu-a.

ances, denials, amendments, transfers, renewals, modifications, suspensions, and revocations; maintenance of a file of registrants possessing sources o'f b.

ionizing radiation requiring registration under the provisions ' of this Act and any administrative or judicial action pertaining thereto; Maintenance of a file of all rules and regulations relating c.

to regulation of sources of ionizing radiation, pending or promul-gated, and proceedings thereon; and d. maintenance of a file of registrants possessing X-ray ma-chines or other unchines and devices producmg ionizing radiation.

Section 5. Radiation Advisary Board. (a) There shall be established a Radiation Advisory Board of Health consisting of nine (9) members appointed by the Governor. The Governor shall appoint one member to the Radiation Advisory Board from a list of three nominees in each of.he following fields: (1) radi- - ology, (2) medicine, (3) radiation or health physics, and (4) ap-plied sciences. These nominees are to be submitted to the Gover- . nor by the State Committee of Public Health. One member of the Radiation Advisory Board shall be appointed from a list of a three nominees submitted to the Governor by the Associated In-i ' dustries of Alabama. One member of the Radiation Advisory - Board shcll be appointed from the University of Alabama from i , J . m v

a list of three nominees having knowledge in the field of radia-tion submitted by the President of the University of Alabama.

One member of the Radiation Advisory Board shall be appointed from Auburn University from a list of three nominees having knowledge in the field of radiation submitted by the President of Auburn University. One member of the Radiation Advisory Board shall be appointed from a list of three nominees sub-mitted to the Governar by the President of the Alabama Dental Association. One member of the Radiation Advisory Eoard shall be appointed from a list of three nominees submitted to the Governor by the Alabama Board of Chiropractic Examiners.

Members of the Board shall serve for terms of six years each, except that of the first board appointed, three members shall serve for two years, three members shall serve for four years and three members shall serve for six years, as the Governor may prescribe.

The members shall receive no salary for services but may be reimbursed for actual expenses incurred in connection with at-tendance at Board meetings or for authorized business of the Board. The State Health Officer shall serve as Chairman of the Board, and the Board shall meet at his request.

(b) The Board shall: (1) Review and evaluate policies and programs of the state relating to ionizing radiation and advise the Agency of its opinions - ! and findings.

(2) Advise the State Radiation Control Agency on any matter submitted to said Advisory Board by said Agency and to propose, oppose, recommend or disapprove in an advisory capacity any matter that may come before said Agency.

Section 6.

Licensing and Registration of Sources of Ionizing Radiation. (a) The Agency shall provide by rule or regulation for general or specific licensing of persons to receive, possess or transfer byproduct, source, special nuclear materials, devices or equipment utilizing such materials or any other radioactive

material occurring naturally or produced artificially. Such rule or regulation shall provide for amendment, suspension, or revo- , ! cation of licenses.

, l (b) The Agency is a 2thorized to require registration and in-spection of persc,ns dealing with ionizing radiation which does not require a specific license, and may require compliance with specific safety standards to be promulgated by the Agency.

(c) The Agency is authorized to exempt certain sources of ionizing radiation or kinds of uses or users from the licensing or registration requirements set forth in this section when the s - Agency makes a finding that the exemption of such sources of . - - - - - _ _ _.

-ionizing radiation or kinds of uses or users will not constitute a significant risk to the health and safety of the public.

(d) Any report of investigation or inspection or any infor- '

mation concerning trade secrets or secret industrial processes ) obta' ed under this Act shall not be disclosed or opened to public m inspection by the Agency.

(e) Rules and regulations promulgated pursuant to this Act

may provide for recognition of other state or Federal licenses as the Agency may deem desirable, subject to such registration re-quirements as the Agency may prescribe.

Section 7.

Inspection. The Agency or its duly authorized representatives shall have the power to enter at all reasonable times upon any private or public property for the purpose of determining whether or not there is compliance with or viola-tion of the provisions of this Act and rules and regulations issued thereunder, and the owner, occupant, or person in charge of such N property shall permit such entry and inspection, except that entry into areas under the jurisdiction of the Federal Government , shall be effected only with the concurrence of the Federal Govern-ment or its duly designated representative.

Section 8.

Records. (a) The Agency shall require each per-son who acquires, possesses, or uses a source of ionizing radiation to maintain records relating to its receipt, storage, transfer, or disposal and such other records as the Agency may require sub-ject to exemptions as may be provided by rules or regulations.

(b) The Agency shall require each person who possesses or uses a source of ionizing radiation to maintain appropriate records showing the radiation exposure of all individuals for whom per-sonnel monitoring is required by rules and regulations of the Agency. Copies of these records and those required to be kept by subsection (a) of this section shallbe submitted to the Agency on request.

(c) The agency shall adopt reasonable regulations, co.m-patible with those of the United States Atomic Energy Commis - sion or any successor thereto, pertaining to reports of exposure of personnel. Such regulations shall require that reports of excess exposure be made to the individual exposed and to the Agency, and shall make provision for periodic and terminal reports to individuals for whom personnel monitoring is required.

(d) The provisions of this Act shall not be construed to limit the kind or amount of radiation that may be intentionally applied to a person for diagnostic or therapeutic purposes by or under the direction of a licensed practitioner of the healing arts.

'7 l Section S. Federal-State Agreements. (a) The Governor, on behalf of this state, is authorized to enter into agreements with the Federal Government providing for discontinuance of certain of the Federal Government's responsibilities with respect to sources of ionizing radiation and the assumption thereof by this state.

(b) Any person who, on the effective date of an agreement i under subsection (a) above, possesses a license issued by the Federal Government shall be deemed to possess the same pursuant to a license issued under this Act, which shall expire either 90 days after receipt from the Agency of a notice of expiration of such license, or on the date of expiration specified in the Federal license, which ever is earlier.

Section 10. Inspection Agreements and Training Programs.

(a) The Agency is authorized to enter into an agreement or agreements with the Federal Government, other states or in-terstate agencies, whereby this state will perform on a coopera-tive basis with the Federal Government, other states or interstate agencies, inspections or other functions relating to control of sources of ionizing radiation.

(b) The Agency may institute training programs for the pur-pose of qualifying personnel to carry out the provisions of this Act, and may make said personnel available for participation in any program or programs of the Federal Government, other states or interstate agencies in furtherance of the purposes of this Act.

Section 11. Conflicting Laws. Ordinances, resolutions or regulations, now or hereafter in effect, of the governing body of a municipality or county or board of health relating to byproduct, source, special nuclear materials, other radioactive materials oc-curring naturally or produced artificially, or machine produced radiation shall not be superseded by this Act, if such ordinances or regulations are and continue to be consistent with the provi-I sions of this Act, amendments thereto and rules and regulations thereunder; but the authority of the Agency under this Act shall be paramount to that of any county, city, or town.

I Section 12. Administrative Procedure and Judicial Review.

(a) In any proceeding under this Act: (1) for the issuance or modification of rules and regulations relating to control or sources of ionizing radiation; or (2) for granting, suspending, revoking, or amending any h,eense; or (3) for determining compliance with rules and regulations of the Agency, the Agency shall afford an opportunity for a u .

M hearing on the record upon the request of any person whose in-terest may be affected by the proceeding, and shall admit any such person as a party to such proceeding.

(b) Whenever the Agency finds that an emergency exists requiring immediate action to protect the public health and safety the Agency may, without notice or hearing, issue a regulation or order reciting the existence of such emergency and requiring that such action be taken as is necessary to meet the emergency.

Notwithstanding any provision of this Act, such regulation or order shall be effective immediately. Any person to whom such regulation or order is directed shall comply therewith immediate-ly, but on application to the Agency shall be afforded a hearing i within 30 days. On the basis of such hearing, the emergency ' regulation or order shall be continued, modified or revoked within i 30 days after such hearing.

(c) Any final order entered in any proceeding under sub-sections (a) and (b) above shall be subject to judicial review by the circuit court of Montgomery County in the manner prescribed for taking appeals from orders of the Alabama Public Service Commission as provided in Code 1940, Title 48, Section 79 and following.

Section 13. Injunction Proceedings. Whenever in the judg-ment of the Agency any person has engaged in or is about to engege in any acts or practices which constitute or will constitute a violation of any provision of this Act, or any rule, regulation or order issued thereunder, and at the request of the Agency, the Attorney General or the Circait Solicitor under his direction mav make application to the circuit court for an order enjoining such acts or practices, or for an order directing compliance, and upon a showing by the Agency that such person has engaged or is about to engage in any such acts or practices, a permanent f, or temporary injunction, restraining order, or other order may be granted.

( y Section 14. Prohibited Uses. It shall be unlawful for any g person to use, manufacture, produce, knowingly transport, trans-fer, receive, acquire, own or possess any source of ionizing radia-

tion unless licensed by or registered with the Agency in accord-ance with the provisions of this Act and the rules and regulations t issued thereunder, i Section 15. Impounding of Materials. The Agency shall have the authority in the event of an emergency to impound or order the impounding of sources of ionizing radiation in the possessien of any person who is not equipped to observe or fails to observe the provisions of this Act or any rules or regulations issued there- , under.

Section 16. Penalties. Any person who wilfully violates any of the provisions of this Act or rules, regulations or orders in effect pursuant thereto of the Agency shall upon conviction there-of be punished by fine not exceeding 1,000 dollars or by imprison-ment in the county jail er by a sentence to hard labor for the county not exceeding 12 months, or by both fine and imprison- ,. ment or hard labor.

Section 17. Appropriations. There is hereby appropriated to the State Radiation Control Agency out of the general fund in the state treasury not otherwise appropriated the sum of $50,- 000.00 for each fiscal year ending September 30,1964 and Septem-ber 30,1965 to be used for carrying out the purpose of this act.

There is hereby appropriated to said agency all funds appropriated or made available to said agency by the Congress or the Federal Government for the purpose of carrying out this act.

Section 18. Severability. The provisions of this Act are severable. If any part of the Act is declared invalid or unconstitu-tional, such declaration shall not affect the part which remains.

Section 19. Repealer. Alllaws or parts of laws which con-flict with this Act are repealed.

Section 20. Effective Date. The provisions of this Act relat-ing to the control of byproduct, source and special nuclear materi- , als shall become effective on the effective date of the agreement . between the Federal Government and this state as provided in The provisions of this Act relating to the Section 9 of this Act.
