s Appendix NOTICE OF VIOLATION Gamma Field Radiographic Facility License No. 12-13858-01 As a~ result of the inspection conducted on June 21, 1985, and in accordance with the NRC Enforcement Policy, 47 FR 9987 the following violations were identified: License Condition No.17 requires that licensed material be possessed and used in accordance with the statements, representations, and procedures contained in certain referenced applications and letter The referenced application dated September 23, 1980 states in Item and the Training Programs Manual attached to the application, that certain requirements must be completed before an employee with previous experience can be recertified and allowed to work as a radiographer, or radiographer's. assistant. Section 5.4 of the referenced manual requires that the worker successfully pass the test established for radiographer's assistan Contrary to this requirement, the licensee failed to test, or recertify an employee who acted as a radiographer's assistant during the period from February 20, 1985 to May 22, 198 This is a Severity Level IV violation (Supplement VI). License Condition No.17 requires that licensed material be possessed and used in accordance with the statements, representations, and procedures contained in certain referenced applications and letter The referenced application dated September 23, 1980, states in Item Section 5.1 that the Radiation Protection Officer will perform unannounced inspections at least, at three month intervals of each radiographer and radiographer's assistan Contrary to this requirement, the Radiation Protection Officer failed to perform unannounced inspections of radiographers and radiographer's assistants during 1984, and to the day of the inspection, June 21, 198 This is a Severity Level IV violation (Supplement VI). 10 CFR 71.5(a) requires that no licensee shall transport any. licensed material outside of the confines of his plant or other place of use unless the licensee complies with the applicable regulations of the Department of Transportation in 49 CFR Parts 170-18 CFR 172.203(d)(IV) requires that each shipping paper issued in connection with a radioactive shipment, list the category of label applied to each package in the shipmen Contrary to this requirement, the licensee transported radioactive materials to temporary job sites in Illinois and Indiana'during 1984, and to the day of the inspection, June 21, 1985, and failed to list on the shipping papers issued in connection with those shipments the category of label applied to each package in the shipment This is a Severity Level V violation (Supplement V).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each item of. noncompliance: (1) cor-rective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full ccmpliance will be achieved. Consideration may be given to extending your response time for good cause shown.
