I APPENDIX A NOTICE OF VIOLATION Niagara Mohawk Power Corporation Docket No. 50-220 Nine Mile Point Unit 1 License No. DPR-63 As a result of the inspection conducted on June 15 through 18, 1982 and in accordance with the NRC Enforcement Policy (10 CFR Part 2, Appendix C), 47 FR 9987 (March 9, 1982), the following violation was identified:
A. 10 CFR 50, Appendix B, criterion V, requires activities affecting quality to be prescribed by and accomplished in accordance with documented instructions or procedures of a type appropriate to the circumstances.
The licensee's Fire Prctection Quality Assurance Program, dated June 25, 1979, Section 3.3, requires inspections tests, administrative controls, fire drills, and training required by the Fire Protection System be accomplished in accordance with current approved instructions or procedures. Fire Prevention Procedure No. NI-FP-2, " Welding and Cutting", requires a fire watch be stationed during welding and cutting operations.
Contrary to the above, on June 17, 1982, Fire Protection activities were not conducted in accordance with approved procedures in that welding was observed in the Screen and Pump House without a fire watch present.
This is a Severity Level V violation (Supplement I)
Pursuant to the provisions of 10 CFR 2.201, Niagara Mohawk Power Corporation is hereby required to submit to this office within twenty-five days of the date of this Notice, a written statement or explanation in reply, including:
(1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended this response shall be submitted under oath or affirmation.
