w-sl$ APPENDIX A NOTICE OF VIOLATION Niagara Mohawk Power Company Docket No. 50-220/50-410 Nine Mile Point I and 2 License No. DPR-63/NPF-54 As a result of the inspection conducted on November 17, 1986 to January 4, 1987, and in accordance with the NRC Enforcement Policy (10 CFR 2, Appendix C),

the following violations were identified:

A. Technical Specification 3.4.0 requires that Reactor Building integrity must be in effect in the power operating condition. Technical Specifi-cation definition 1.12, Reactor Building Integrity, requires that the reactor building be closed and at least one door at each access opening is closed.

Contrary to the above, on December 10, 1986, with the Unit I reactor at

, full power, a security guard momentari!y violated Reactor Building integrity by opening the Reactor Building air lock door while the Turbine Building air lock door was also open.

This is a Severity Level IV Violation (Supplement I) applicable to Docket No. 50-220.

B. 10 CFR 50, Appendix B, Criterion XVI requires that conditions adverse to quality be promptly identified, the cause determined and proper corrective action taken to preclude repetition.

NMPC Quality Assurance Topical Report, Section 16, Corrective Action, requires that for significant conditions adverse to quality, corrective action includes determining the cause and extent of the condition and taking appropriate action to minimize similar problems in the future.

Contrary to the above, on December 15, 1986, a Uni. 2 Scram Discharge

Volume (SDV) High Level trip occurred subsequent to resetting a scram signal resulting form operator error. A similar SDV High Level Trip occurred on November 5, 1986. Licensee corrective action in response to i

the November 5 reactor trip, as documented in LER No. 86-01, was not effective in preventing the automatic reactor trip on December 15.

This is a Severity level V violation (Supplement I) applicable to Docket No. 50-410.

Pursuant to the provisions of 10 CFR 2.201, the Niagara Mohawk Power Company is hereby required to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in

! reply to violation B, including: (1) corrective actions which have been taken

! and results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved. Where good j cause is shown, consideration will be given to extending this response time.
