COMANCHE PEAK - MISCONDUCT BY NRC EMPt.0YEES The' attached Office of Inspector and Auditor (01A), U.S. Nuclear Pegulatory Commission (NRC), Memorandum Report documents our investigation into alleged misconduct by two NRC employees. This allegation was reported to 01A by Vincent. S. N0ONAN, Director, COMANCHE PEAK PROJECT, NRC, by memorandum dated March 28, 1985. In this memorandum, N0ONAN stated that representatives of his C0MANCHE PEAK PROJECT staff had been informed that two NRC employees allegedly

. guaranteed a confidential alleger five or six years employment if he agreed not to further pursue allegations that he had made concerning irregularities at the COMANCHE PEAK STEAM ELECTRIC STATION (COMANCHE PEAK).

Our investigation detennined that on August 24, 1983, Richard K. HERR, Director, Office of Investigations (01) Field Office, Region IV, NRC, and H. Brooks GRIFFIN, Investigator, O! Field Office, Region IV, interviewed the '

confidential alleger concerning irregularitin at COMANCHE PEAK. However, both HERR and GRIFFIN denied ever guaranteeing the confidential alleger emplofment if he would not pursue his allegations further. When interviewed by OIA, the confidential alleger also asserted that neither HERR, GRIFFIN, nor any other NRC employee, ever offered him guaranteed employment if f e would not pursue allegations that he had made. Furthermore, the confidential alleger denied telling anyone that this offer had been made.

Conclusion:

The 01A investigation did not identify any misconduct on the part of any NRC employee. The facts do not substantiate the allegation that two NRC employees guaranteed a confidential alleger continued employment if he agreed not to pursue his allegations.
