34.0APPLICABILITYSURVEILLANCEREUIREMENTS4.0.1SurveillancerequirementsshallbeapplicableduringtheOPERATIONALMODESorotherconditionsspecifiedforindividualLimitingConditionsforOperationunlessotherwisestatedinanindividualSurveillanceRequirement.4.0.2EachSurveillanceRequirementshallbeperformedwithinthespecifiedtimeintervalwithamaximumallowableextensionnottoexceed25%ofthespecifiedsurveillanceinterval.4.0.3PerformanceofaSurveillanceRequirementwithinthespecifiedtimeintervalshallconstitutecompliancewithOPERABILITYrequirementsforaLimitingConditionforOperationandassociatedACTIONstatementsunlessotherwiserequiredbythespecification.IntheeventaSurveillanceRequirementismissed,thetimelimitsoftheACTIONrequirementsareapplicableatthetimeitisidentifiedthataSurveillanceRequirementhasnotbeenperformed.However,theACTIONrequirementsmaybedelayedforupto24hourstopermitthecompletionofthesurveillancewhentheallowableoutagetimelimitsoftheACTIONrequirementsarelessthan24hours.Surveillancerequirementsdonothavetobeperformedoninoperableequipment.4.0.4EntryintoanOPERATIONALMODEorotherspecifiedapplicabilityconditionshallnotbemadeunlesstheSurveillanceRequirement(s)associatedwiththeLimitingConditionforOperationhavebeenperformedwithinthestatedsurveillanceintervalorasotherwisespecified.4.0.5SurveillanceRequirementsforinserviceinspectionandtestingofASMECodeClass1,2,and3componentsshallbeapplicableasfollows:InserviceinspectionofASMECodeClass1,2,and3componentsandinservicetestingofASMECodeClass1,2and3pumpsandvalvesshallbeperformedinaccordancewithSectionXIoftheASMEBoilerandPressureVesselCodeandapplicableAddendaasrequiredby10CFR50,Section50.55a(g),exceptwherespecificwrittenreliefhasbeengrantedbytheCommissionpursuantto10CFR50,Section50.55a(g)(6)(i).COOKNUCLEARPLANT-UNIT13/40-2AMENDMENTNO.QS,
,~a~y~&jJ+.ay~Hg<II~1'i'd~yl'l~,AJ APPLICABILITYBASES4.0.1ThisspecificationprovidesthatsurveillanceactivitiesnecessarytoinsuretheLimitingConditionsforOperationaremetandwillbeperformedduringtheOPERATIONALMODESorotherconditionsforwhichtheLimitingConditionsforOperationareapplicable.ProvisionsforadditionalsurveillanceactivitiestobeperformedwithoutregardtotheapplicableOPERATIONALMODESorotherconditionsareprovidedintheindividualSurveillanceRequirements.4.0.2ThisspecificationestablishesthelimitforwhichthespecifiedtimeintervalforSurveillanceRequirementsmaybeextended.Itpermitsanallowableextensionofthenormalsurveillanceintervaltofacilitatesurveillanceschedulingandconsiderationofplantoperatingconditionsthatmaynotbesuitableforconductingthesurveillance,e.g.,transientconditionsorotherongoingsurveillanceormaintenanceactivities.Italsoprovidesflexibilitytoaccommodatethelengthofafuelcycleforsurveillancesthatareperformedateachrefuelingoutageandarespecifiedwithan18-monthsurveillanceinterval.Itisnotintendedthatthisprovisionbeusedrepeatedlyasaconveniencetoextendsurveillanceintervalsbeyondthatspecifiedforsurveillancesthatarenotperformedduringrefuelingoutages.ThelimitationofSpecification4.0.2isbasedonengineeringjudgmentandtherecognitionthatthemostprobableresultofanyparticularsurveillancebeingperformedistheverificationofconformancewiththeSurveillanceRequirements.Thisprovisionissufficienttoensurethatthereliabilityensuredthroughsurveillanceactivitiesisnotsignificantlydegradedbeyondthatobtainedfromthespecifiedsurveillanceinterval.\4.0.3TheprovisionsofthisspecificationsetforththecriteriafordeterminationofcompliancewiththeOPERABILITYrequirementsoftheLimitingConditionsforOperation.Underthiscriteria,equipment,systemsorcomponentsareassumedtobeOPERABLEiftheassociatedsurveillanceactivitieshavebeensatisfactorilyperformedwithinthespecifiedtimeinterval.Nothinginthisprovisionistobeconstruedasdefiningequipment,systemsorcomponentsOPERABLE,whensuchitemsarefoundorknowntobeinoperablealthoughstillmeetingtheSurveillanceRequirements.ACTIONrequirementsareapplicablewhenSurveillanceRequirementshavenotbeencompletedwithintheallowedsurveillanceinterval.ThetimelimitsoftheACTIONrequirementsapplyfromthepointintimeitisidentifiedthatasurveillancehasnotbeenperformedandnotfromthetimethattheallowedsurveillanceintervalwasexceeded.CompletionoftheSurvei.llanceRequirementwithintheallowableoutagetimelimitsoftheACTIONrequirementsrestorescompliancewiththerequirementsofSpecification4.0.3.However,thisdoesnotnegatethefactthatthefailuretohaveperformedthesurveillancewithintheallowedsurveillanceinterval,definedbytheprovisionsofSpecification4.0.2,isaviolationoftheOPERABILITYrequirementofaLimitingConditionforOperationthatissubjecttoenforcementaction.Further,thefailuretoperformasurveillancewithintheprovisionsofSpecification4.0.2isaviolationofaTechnicalSpecificationrequirementandis,therefore,areportableeventundertherequirementsof10CFR50.73(a)(2)(i)(B)becauseitisaconditionprohibitedbytheplant'sTechnicalSpecifications.COOKNUCLEARPLANT-UNIT1B3/40-4AMENDMENTNO.46,
'gI(3Y.1Cy4)~4>I4p4'F1lr',l APPLICABILITYBASESIftheallowableoutagetimelimitsoftheACTIONrequirementsarelessthan24hoursorashutdownisrequiredtocomplywithACTIONrequirements,e.g.,Specification3.0.3,a24-hourallowanceisprovidedtopermitadelayinimplementingtheACTIONrequirements.ThisprovidesanadequatetimelimittocompleteSurveillanceRequirementsthathavenotbeenperformed.ThepurposeofthisallowanceistopermitthecompletionofasurveillancebeforeashutdownisrequiredtocomplywithACTIONrequirementsorbeforeotherremedialmeasureswouldberequiredthatmayprecludecompletionofasurveillance.Thebasisofthisallowanceincludesconsiderationforplantconditions,adequateplanning,availabilityofpersonnel,thetimerequiredtoperformthesurveillance,andthesafetysignificanceofthedelayincompletingtherequiredsurveillance.Ifasurveillanceisnotcompletedwithinthe24-hourallowance,thetimelimitsoftheACTIONrequirementsareapplicableatthattime.Whenasurveillanceisperformedwithinthe24-hourallowanceandtheSurveillanceRequirementsarenotmet,thetimelimitsoftheACTIONrequirementsareapplicableatthetimethatthesystemorcomponentisdeterminedtobeinoperableasaresultofthesurveillance.4.0.4ThisspecificationensuresthatthesurveillanceactivitiesassociatedwithaLimitingConditionforOperationhavebeenperformedwithinthespecifiedtimeintervalpriortoentryintoanOPERATIONALMODEorotherapplicablecondition.Theintentofthisprovisionistoensurethatsurveillanceactivi.tieshavebeensatisfactorilydemonstratedonacurrentbasisasrequiredtomeettheOPERABILITYrequirementsoftheLimitingConditionforOperation.Underthetermsofthisspecification,forexample,duringinitialplantstartuporfollowingextendedplantoutages,theapplicablesurveillance,activitiesmustbeperformedwithinthestatedsurvei.llanceintervalpriortoplacingorreturningthesystemorequipmentintoOPERABLEstatus.4.0.5ThisspecificationensuresthatinserviceinspectionofASMECodeClass1,2and3componentsandinservicetestingofASMECodeClass1,2and3pumpsandvalveswillbeperformedinaccordancewithaperiodicallyupdatedversionofSectionXIoftheASMEBoilerandPressureVesselCodeandAddendaasrequiredby10CFR50.55a.RelieffromanyoftheaboverequirementshasbeenprovidedinwritingbytheCommissionandisnotapartofthesetechnicalspecifications..ThisspecificationincludesaclarificationofthefrequenciesforperformingtheinserviceinspectionandtestingactivitiesrequiredbySectionXIoftheASMEBoilerandPressureVesselCodeandapplicableAddenda.Thisclarificationisprovidedtoensureconsistencyinsurveillanceintervalsthroughoutthesetechnicalspecificationsandtoremoveanyambiguitiesrelativetothefrequenciesforperformingandtherequiredinserviceinspectionandtestingactivities.Underthetermsofthisspecification,themorerestrictiverequirementsoftheTechnicalSpecificationstakeprecedenceovertheASMEBoilerandPressureVesselCodeandapplicableAddenda.Forexample,therequirementsofSpecification4'.4toperformsurveillanceactivitiesCOOKNUCLEARPLANT-UNIT1B3/40-5AMENDMENTNO.~
