APPENDIX A NOTICE OF VIOLATION Baltimore Gas and Electric Company Docket No. 50-317 Baltimore, Maryland 21203 License No. DPR-53 Based on the results of an NRC inspection conducted on October 22 through November 14, 1980, it appears that one of your activities was nct conducted in full compliance with the conditions of your NRC License No. D,PR-53 as discussed below:

10 CFR 50, Appendix B, Criterion VII, " Control of Purchased M3terial, Equipment, and Services," states, in part, that, " Measures shall be established to assure that purchased material, equipment and services, whether purchased directly or through contractors and subcontractors, conform to the procurement documents.

These measures shall include...

objective evidence of quality furnished by the contractor or subcontractor Documentary evidence that material and equipment conform to the procurement requirements... prior to installation or use of such material and equipment...."

The Baltimore Gas and Electric Company Quality Assurance Manual, Section 7, titled, " Control of Purchased Material, Equipment and Services,"

states, in part, that, "The quality of purchased material, equipment, components and services in control by procurement documents, supplier selection, supplier surveillance and receipt inspection... identification of materials and parts important to the function of safety related structures, systems, and components can be traced to appropriate documentation such as drawings, specifications, purchase orders, manufacturing and inspection documents, deviation reports and physical and chemical mill-test reports...."

The spent fuel storage racks engineering specification number SP-267, High Density Fuel Rack for Unit 1,"

dated 1/26/78 specified that fabrication would be in accordance with the ASME Boiler and Pressure Vessel Code, 1977 Edition through Winter 1977 addenda,Section III, Subsection NF, Class II requirements.

Contrary to the above, it could not be established that measures had been established to assure that the spent fuel storage racks met the specification.

Spot welds on racks instalice in the Unit 1 fuel pool did not meet ASME Code requirements as included in the above specification.

This item is an infraction.
