l APPENDIX A Notice of Violation Baltimore Gas and Electric Company Docket / License Nos.:

50-317; DPR-53 Calvert Cliffs Nuclear Power Plant 50-318; DPR-69 As a result of the inspection conducted on July 4 - August 28,1989, and in accordance with the NRC Enforcement Policy (10 CFR 2, Appendix C), the follow-ing violations were identified:

A.

Technical Specification (TS) 3.7.11.3, requires that an hourly fire watch, with backup fire suppression equipment, be established within one hour of the Halon System becoming inoperable.

Contrary to the above, between June 29, 1989 and July 20, 1989, the Halon System was disabled and therefore not operable and the required hourly fire watch was not established, i

This is a Severity Level IV violation (Supplement I) applicable to DPR-53.

B.

Technical Specification Requirement 4.9.12.1, specifies in part, that the spent fuel pool ventilation system shall be demonstrated operable by verifying that each exhaust fan operates for at least 15 minutes at least once per 31 days.

Contrary to the above, as of July 31, 1999, the surveillance test require-ments for the spent fuel ventilation system exhaust fans could not be verified to have ever been performed.

This is a Severity Level IV violation (Supplement I) applicable to DPR-53.

Pursuant to the provisions of 10 CFR 2.201, Baltimore Gas and Electric Company 1

is hereby required to submit to this office within thirty days of the date of l

this Notice, a written statement or explanation in reply, including:

(1) the 1

corrective steps which have been taken and the results achieved; (2) corrective i

steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved.

Where good cause is shown, consideration will be given to extending the response time.
