As a result of the inspection conducted on August 29 - October 2,,1989, and in

[

accordance with the " General Statement of Policy and Procedure for NRC Enforce-ment Actions," 10 CFR Part 2, Appendix C (Enforcement Policy 1988), the follow-ing violation was identified:

10 CFR Part 50, Appendix B, Criterion XVI requires :.nat measures shall be established to assure that conditions adverse to quality, such as defici-encies, are promptly identified and corrected.

I Contrary to the above, the licensee repeatedly failed to take actions to correct a deficiency that resulted in a condition adverse to quality in that, after receiving notice from the NRC during February-March 1988, on May 5,1988 and on July 24, 1989, the licensee did not modify plant emerg-ency procedures to incorporate proper void control requirements for natural circulation cooldown situations.

Rather, the licensee retained L

emergency procedure requirements that were inadequate as void elimination or reduction was not required until natural circulation heat removal capacity was actually inhibited.

This is a Severity Level IV violation (Supplement 1).

Pursuant to the provisions of 10 CFR 2.201, Baltimore Gas and Electric Company is hereby required to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including:

(1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and -(3) the date when full compliance will be achieved.

Where good cause is shown, consideration will be given to extending the response time.
