INDIAN POINT ENERGY CENTER - STATUS OF EXEMPTIONS FROM THE REQUIREMENTS OF 10 CFR 50.54(w)(1) CONCERNING ONSITE PROPERTY DAMAGE INSURANCE (L-2022-LLE-0010) AND THE REQUIREMENTS OF 10 CFR 140.11(a)(4) OFFSITE PRIMARY AND SECONDARY LIABILITY INSURANCE (L-2022-LLE-0012)

By your request, the purpose of this letter is to provide the U.S. Nuclear Regulatory Commission (NRC) staffs review status for the submittal Request for Exemption from 10 CFR 50.54(w)(1)

Concerning Indian Point Energy Center Onsite Property Damage Insurance, dated March 18, 2022 (Agencywide Documents Access and Management System (ADAMS)

Accession No. ML22077A132), and Request for Exemption from 10 CFR 140.11(a)(4)

Concerning Primary and Secondary Liability Insurance dated March 25, 2022 ( ML22084A103).

These requests were submitted by Holtec Decommissioning International, LLC (HDI) to make changes to the onsite and offsite insurance coverage level exemptions for the Indian Point Energy Center (IPEC) to reflect the permanent shutdown and removal of fuel from the IPEC reactors. With respect to the acceptance emails for the onsite and offsite insurance coverage levels dated April 21, 2022 ( ML22112A010 and ML22112A012), the NRC staff advised that emergent complexities or challenges with review could cause changes to the initial forecasted completion date and would be communicate during routine interactions with the assigned project manager.

The NRC staff continues to evaluate HDIs two exemptions and will grant the onsite and offsite insurance exemption requests, as justified by a favorable conclusion from the ongoing technical and financial review once Commission approval of an associated emergency planning exemption request is secured. The NRC staffs analysis of the IPEC emergency planning exemptions provides part of the basis for approval of the IPEC insurance exemptions, and therefore the emergency planning exemptions must be approved before the staff can move forward with the insurance exemptions. Commission approval of the IPEC emergency planning exemptions is being pursued in accordance with the Staff Requirements Memorandum (SRM) for SECY-08-0024, Delegation of Commission Authority to Staff to Approve or Deny Emergency Plan Changes that Represent a Decrease in Effectiveness, dated May 19, 2008 (ML081400510). February 8, 2023 Presently, the NRC staff is waiting for the Commission to vote and issue an SRM for SECY 0102, Request by Holtec Decommissioning International, LLC for Exemptions from Certain Emergency Planning Requirements for Indian Point Nuclear Generating Unit Nos. 1, 2, and 3, dated November 18, 2022 ( ML22231A155). The NRC staff estimates that if the Commission grants within 90 days the IPEC emergency planning exemption, approximately four additional weeks will be needed to issue approval of the IPEC emergency planning exemption and the onsite and offsite insurance coverage level exemptions.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs ADAMS.
