APPROVAL OF AMERICAN CENTRIFUGE OPERATINGS LICENSE AMENDMENT REQUEST TO INCREASE ITS POSSESSION LIMITS TO SUPPORT A HIGH-ASSAY LOW-ENRICHED URANIUM PRODUCTION INCREASE AT THE AMERICAN CENTRIFUGE PLANT (ENTERPRISE PROJECT IDENTIFIER L-2023-LLA-0024)

By letter dated February 13, 2023 (Agencywide Documents Access and Management System

[ADAMS] Accession No. ML23047A046), American Centrifuge Operating, LLC (ACO), a wholly owned subsidiary of Centrus Energy Corp., requested review and approval of proposed changes to special nuclear material license SNM-2011 to increase the possession limits from the current level approved on June 11, 2021 ( ML21138A827, ML21148A291, and ML21138A828) to support an increase in high-assay low-enriched uranium production to approximately 1400 kg UF 6 at the American Centrifuge Plant (ACP) in Piketon, Ohio.

The U.S. Nuclear Regulatory Commission (NRC) staff has completed its review of the February 13, 2023, request. The details associated with the review are documented in the enclosed non-public safety and security evaluation report (SER). A redacted public version of the SER is also enclosed. As part of this licensing action, License Conditions (LCs) 10.e and 10.y have been modified to incorporate, in the enclosed license, (1) the license application LA-3605-0001 submitted on February 13, 2023 ( ML23047A046), and its supplements on June 29, 2023 ( ML23187A143), February 15, 2024 ( ML24054A033), and March 7, 2024 ( ML24072A046), and (2) the physical security plan for the ACP SP-3605-0042 submitted on February 15, 2024 ( ML24054A033), respectively.

Additionally, new LC 30 has been added to the license (full text below):

LC 30 ACO shall establish and maintain a Vehicle Barrier System in accordance with Section 3.7 of SP-3605-0042. Additionally, ACO shall not produce more than the authorized possession limits beyond those approved on June 11, 2021, until such time that the additional physical security measures have been installed and Enclosures 1 and 2 transmitted herewith contain sensitive security related information. When separated from the sensitive conditions in the enclosures, this document and enclosures 3 and 4 are decontrolled.September 20, 2024 OFFICIAL USE ONLY - SECURITY RELATED INFORMATION OFFICIAL USE ONLY - SECURITY RELATED INFORMATION K. Fitch 2 NRC has confirmed they meet the new commitments described within Section 3.7 of SP-3605-0042. Upon a successful NRC validation, ACO will be authorized to continue production efforts up to the authorized possession limits described in SNM-2011.

The NRC staff prepared an environmental assessment (EA) to determine whether there would be any significant environmental impacts associated with this amendment request (ML24254A206). The EA was noticed in the Federal Register on September 19, 2024 (89 FR 76871, ML24214A324).

In accordance with Title 10 of the Code of Federal Regulations, Part 2 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter and enclosures 3 and 4 will be available electronically for public inspection in the NRC Public Document Room (PDR), or from the Publicly Available Records component of the NRCs ADAMS.
