WESTINGHOUSE ELECTRIC COMPANY, LLC - REVISION TO TEMPORARILY STORE HEMATITE ASH ABOVE LICENSE LIMITS AND REMOVAL OF URANIUM FLYWHEEL (EPID L-2022-LLA-0177 AND L-2022-LLA-0154)

Dear Patrick Donnelly:

The U.S. Nuclear Regulatory Commission (NRC) reviewed the applications from Westinghouse Electric Company, LLC (Westinghouse or WEC) requesting temporary storage of Hematite ash and removal of a depleted uranium flywheel from the renewed license (SNM-1107). The application for the flywheel was transmitted by letter dated October 21, 2022 (Agencywide Documents Access and Management System (ADAMS) No. ML22294A178). The application for the ash was transmitted by letter dated December 2, 2022 (ML22336A174). A Safety Evaluation Report documenting the basis for the NRCs findings for the temporary storage of the Hematite ash is provided in Enclosure 1. The NRC staff determined that the removal of the depleted uranium flywheel from the license is an administrative amendment, and a separate safety evaluation is not needed, the staffs review is discussed below.

By cover letter dated October 21, 2022, Westinghouse submitted a request to remove the depleted Uranium flywheel from the renewed license SNM-1107. Enclosure 1 of the request included documentation of disposal of the depleted uranium flywheel at an approved disposal facility (Waste Control Specialists) on August 30, 2022. The NRC staff has determined that this material can be removed from the Westinghouse SNM-1107 license because it is no longer on site and has been disposed of in an appropriate manner.

Enclosure 3 transmitted herewith contains sensitive non-public information. When separated from the sensitive conditions in the enclosures, this document and Enclosures 1 and 2 are not controlled.

P. Donnelly 2 OFFICIAL USE ONLY - SECURITY-RELATED INFORMATION The NRC staff has completed review of both the October 21, 2022, and December 2, 2022, request. As part of these licensing actions, Item 8G Depleted uranium, flywheel is removed from SNM- 1107. Additionally, two temporary license conditions are added to SNM-1107 and will be removed upon completion of the Hematite ash campaign. The text of the license conditions are:

License Condition S-19: The licensee shall not alter the current storage configuration or location of the nine 55-gallon drums containing Hematite ash in excess of 5.0 wt.% 235U for a period of six months, or upon completion of the Hematite ash campaign, as described in the NRCs license amendment approval letter dated May 5, 2023.

License Condition S-20: The licensee shall maintain at least 12 inches edge-to-edge spacing between the nine 55-gallon drums containing Hematite ash in excess of 5.0 wt.% 235U and all other fissionable material for a period of six months, or upon completion of the Hematite ash campaign, as described in the NRCs license amendment approval letter dated May 5, 2023.

This action closes activities under Enterprise Project Identifiers (EPIDS) L-2022-LLA-0177 and L-2022-LLA-0154.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records System component of NRCs Agencywide Documents Access and Management System (ADAMS).
