WESTINGHOUSE ELECTRIC COMPANY, LLC. - ORDER APPROVING INDIRECT TRANSFER OF CONTROL OF LICENSES
Dear Michael T. Sweeney:
The U.S. Nuclear Regulatory Commission (NRC) reviewed the application from Westinghouse Electric Company LLC (Westinghouse) requesting consent from the NRC to the indirect transfer of control of materials and export licenses. The application was transmitted by letter dated December 20, 2022 (Agencywide Documents Access and Management System [ADAMS]
Accession Number ML22354A291) and supplemented by letters dated February 17 and February 27, 2023 (ML23053A070 and ML23053A074 and ML23053A070, respectively).
Westinghouse submitted its application pursuant to Sections 70.36, Inalienability of licenses, and 110.50, Terms, of Title 10 of the Code of Federal Regulations (10 CFR). The NRC determined that the proposed indirect transfer of control is in accordance with the Atomic Energy Act of 1954, as amended, and hereby approves the indirect transfer of control, which will not change Westinghouses operations, structure, locations, facilities, equipment, or procedures associated with licensed activities. A safety evaluation report documenting the basis for the NRCs findings is provided in Enclosure 1. An order approving the indirect transfer of control is provided in Enclosure 2.
The order will be published in the Federal Register. This action closes activities under Enterprise Project Identifier L-2022-LLM-0004.
In accordance with 10 CFR Part 2, Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from ADAMS.
