SUBMITTAL OF AMENDMENT 4 TO STANDBY TRUST AGREEMENT (STA) FOR LICENSE NUMBER SNM-1107, REPLACEMENT OF TRUST FUND WITH ADDITIONAL SURETY BONDS, AND CERTIFICATION OF FINANCIAL ASSURANCE FOR SNM-1107 (PROPRIETARY/NON-PROPRIETARY)

Dear Director:

Westinghouse Electric Company LLC ("Westinghouse") is submitting documentation that establishes additional surety bonds for decommissioning funding for Special Nuclear Material (SNM) License No.

SNM-1107 for the Columbia Fuel Fabriaction Facility (CFFF). The additional surety bonds are being established to replace the value in the Standby Trust Agreement (STA) for License No. SNM-1107.

Enclosed are both proprietary and non-proprietary versions of Amendment 4 to the STA for License Number SNM-1107 which replaces the trust fund in the agreement with additional surety bonds. The value of the additional surety bonds is identical to the trust funds value as documented in Amendment 3, Schedule B of the STA dated November 9, 2022 (ML22316A007). In addition, proprietary versions of the additional surety bonds for License No. SNM-1107, a proprietary Certification of Financial Assurance for License No, SNM-1107 and recent bank statement for the STA are included. These enclosures are considered proprietary in their entirety, and non-proprietary versions are not submitted.

This submittal contains proprietary information of Westinghouse Electric Company LLC. In conformance with the requirements of 10 CFR 2.390, as amended, of the Nuclear Regulatory Commission's

("Commission's") regulations, Westinghouse is enclosing with this submittal an Affidavit. The Affidavit sets forth the basis on which the information identified as proprietary may be withheld from public disclosure by the Commission.

Correspondence with respect to the proprietary aspects of this submittal or the Westinghouse Affidavit should reference AW-23-063 and should be addressed to Jeffery Ferguson, Manager, Regulatory Compliance and Environment, Health & Safety, Westinghouse Electric Company LLC, 5801 Bluff Road, Hopkins, SC 29061.

To prevent any gap in decommissioning funding plan coverage, the replacement financial instruments for the STA are fully executed and incurring significant fees until the NRC formally communicates its

Following completion of the NRC technical review, Westinghouse respectfully requests that the NRC acknowledge and sign Amendment No. 4 to the Standby Trust Agreement. We also request after accepting and countersigning the document, that the return a portable document format (PDF) scanned copy of the fully executed document for our records to Jeffery Ferguson, Manager, Regulatory Compliance and Environment, Health, & Safety, Westinghouse Columbia Fuel Fabrication Facility via email to: fergusjb@westinghouse.com.
