Dear Wyatt Padgett:

The U.S. Nuclear Regulatory Commission (NRC) staff has reviewed Urenco USA executed financial assurance instruments for decommissioning submitted via letter LES-21-168-NRC dated December 15, 2021 (Agencywide Documents Access and Management System

{ADAMS} Accession No. ML22063A481). In conjunction with the review of the updated decommissioning cost estimate for 2022 through 2024 submitted by letter dated June 30, 2021 (ML21189A274) and supplemented by letter dated October 11, 2021 (ML21288A078, non-public), which was approved March 8, 2022 (ML22062B309), the NRC staff concludes that the financial assurance instruments are acceptable and that Urenco USA has met decommissioning funding assurance requirements necessary to provide adequate financial assurance for decommissioning.

Pursuant to Part 70 of Title 10 of the Code of Federal Regulations (10 CFR), Materials License SNM-2-10, Condition 10 is hereby amended to read as follows:

10. af Decommissioning Financial Assurance submitted by letters dated December 12, 2019 (ML19351C772); October 12, 2020 (ML20296A196), April 1, 2021 (ML21109A186), and December 15, 2021 (ML22063A481).

The NRC staff basis is documented in the safety evaluation report, which is provided as to this letter. Enclosures 2 and 3 to this letter provide publicly available and non-publicly available versions of the amended Materials License SNM-2010, respectively. This letter concludes action on this submittal and Enterprise Project Identifier (EPID)
