ORDER TERMINATING FACILITY OPERATING LICENSE N0. R-117 - UNIVERSITY OF ILLIN0IS AT URBANA-CHAMPAIGN LOW POWER REACTOR ASSEMBLY (TAC NO. M98404)

Dear Mr. Holm:

The U.S. Nuclear Regulatory Commission (NRC) has issued the enclosed Order ,

(Enclosure 2) terminating Facility Operating License No. R-117 for the '

University of Illinois at Urbana-Champaign's Low Power Reactor Assembly (LOPRA) in accordance with your application dated February 10, 1995, as suppl mented on April 24, 1995; October 2, 1996; and April 15, 1997.

As part of this license termination, the NRC has granted at your request, in accordance with 10 CFR 50.12, a specific exemption (Enclosure 3) to the part of.the requirements in 10 CFR 50.82(b)(6) that requires as a condition of license termination a terminal radiation survey and associated documentation to demonstrate that the facility and site are suitable for release. As discussed in your decommissioning plan and letter of April 15, 1997, the Nuclear Reactor Laboratory in which the LOPRA was housed is also the site of /

the University of Illinois Advanced TRIGA Reactor (TRIGA) (Docket No. 50-151, 1 Facility License No. R-115) and is a restricted environment. The components and fuel from the LOPRA (byproduct and special nuclear material) were transferred to the TRIGA license during decommissioning. Some components h,f containing. byproduct material were subsequently iransferred to a University of Illinois byproduct materials license (License IL-01271-01) issued by the State

, 'of Illinois' to allow the components to be stored at a facility away from the

-Nuclear Reactor Laboratory. The components and fuel will be maintained for

'the capability to construct and operate a suberitical assembly as specifically allowed by the current TRIGA license. This order terminating the license does not releace the Nuclear Reactor Laboratory and LOPRA components for unrestric.:d use. The NRC will consider release of the site and facility components at some future time, when the University applies for termination of the TRIGA license.

In connection with termination of the LOPRA license, we are enclosing two copies of A nendment No.15 to Indemnity Agreement No. E-20 (Enclosure 1).
