On April 1,1982, the Commission approved a final amendment to 10 CFR E50.54(r) modifying the dates and associated power levels for submittal of emergency plans by certain research and test reactor licensees. The final rule was published and became effective on May 6,1982 (47 FR 19512).

Pursuant to the Supplementary Information,Section II, the staff is issuing this generic letter to all research and test reactor licensees requesting that they use Revision 1 to Regulatory Guide 2.6 (for comment) and ANSI /ANS-15.16 (Draft II dated November 29, 1981) to meet the requirement of this final rule.

The enclosed provides information on Emergency Planning requirements for all research and test reactor licensees. This together with the previously distrib-uted NUREG-0849 " Standard Review Plan for the Review and Evaluation of Emergency Plans for Research and Test Reactors" (For Interim Use and Comment.) provides you with the information required for your submittal of an upgraded emergency plan by the respective due dates.

The final rule was published and became effective on May 6, 1982 (47 FR 19512) and amended the emergency planning regulations to:

1.

increase from 500 kilowatts to two megawatts the steady-state themal power level threshold which governs the date by which certain licensees authorized to possess and/or operate research or test reactors must submit upgraded emergency plans; 2.

extend to September 7,1982, the date by which licensees authorized to possess and/or operate research or test reactors at steady-state power levels of two megawatts themal or more must submit upgraded emergency plans; and 3.

require all other licensees authorized to possess and/or operate research and test reactors at steady-state power levels below two megawatts thermal to submit upgraded emergency plans by November 3, 1982.

The emergecy planning regulations were amended because tha 24 licensees in the greater than 500 kilowat category were not able to cc.aply fully with the emergency planning requirements by the November 1981 date. This was attributed to a delay in developing revised guidance criteria to be used by licensees in preparing upgraded emergency plans.

On January 25, 1982, an information letter was transmitted to all research and test reactor licensees by the Office of Nuclear Reactor Regulation. This letter alerted licensees of the proposed rulemaking and provided additional information on the status of guidance criteria for use in the upgrading of emergency plans for research and test reactor facilities. The following documents were referenced in this letter:

Revision 1 to Regulatory Guide 2.6, " Emergency Planning for Research and Test Reactors (for comment)" was published in March 1982. Revision 1 to Regulatory Guide 2.6 endorses Draft II, dated November 29, 1981, of ANSI /ANS-15.16, which is generally consistent with current regulatory requirements and provides specific acceptance criteria for complying with the applicable requirements set forth in 550.54 and in Appendix E to 10 CFR Part 50. These criteria provide a basis for research and test reactor licensees to develop upgraded radiological emergency response plans and improve emergency preparedness at their facilities.

NUREG-0849, " Standard Review Plan for the Review and Evaluation of Emergency Plans for Research and Test Reactors (for interim use and comment)," was published and mailed to each research and test reactor facility in May 1982. This document provides a Standard Review Plan (SRP) for the guidance of the NRC staff to assure that complete and uniform reviews are made of research and test reactor emergency plans.

The SRP is organized under ten planning standards which correspond to the guidance criteria in Draft II of ANSI /ANS-15.16 as endorsed by Revision 1 to Regulatory Guide 2.6.

The items under each planning standard to be given attention in the staff review are subdivided by the steady-state themal power levels at which the reactors are licensed to operate.

Revision 1 to Regulatory Guide 2.6, dated March 1982, and its endorse-ment of Draf t II, ANSI /ANS-15.16, dated November 29, 1981 are not substitutes for the regulations and compliance with them is not required. These documents are issued to describe and make available to licensees and/or applicants and the public methods acceptable to the NRC staff of implementing specific parts of the Commission's regulations. The staf f standard review plan is forwarded to you for informational purposes only. Comments on the Regulatory Guide and staff standard review plan should be sent to the Secretary of the Commission, U. S. Nuclear Regulatory Commission, Washington, D.C.
