Thank you for your letters dated April 18 and May 6,1985, informing us of the steps you have taken to correct the item of noncompliance and deviation which were brought to your attention in NRC Region III Inspection Report 50-151/85001.
We will examine these matters during a subsequent inspection.
Your May 6,1985 letter in followup to our request for information regarding a deviation also expressed concern with respect to the concept of deviations from Safety Analysis Report (SAR) commitments.
Deviations are contained in the Commission's Regulations (10 CFR, Part 2, Appendix C) dated March 8, 1982.
As explained in Part 2, Appendix C.IV.E(3), Notices of Deviation are written notices describing a licensee's failure to satisfy a commitment, such as those contained in the SAR.
Notices of Deviation are used to request a response from the licensee describing what corrective actions will be taken, the results achieved, and the date they were or will be completed.
Such requests are normally contained in the cover letter accompanying the inspection report and not in a formal Notice of Violation.
Use of this method of enforcement is not a new movement on the part of the NRC.
I have carefully reviewed your comments regarding the out-of-service Continuous Air Particulate Monitor and conclude the deviation was appropriate.
