1 NOTICE OF VIOLATION lES Utilities, Inc. Docket No. 50-331 Duane Amold Energy Center License No. DPR-49 During an NRC inspection conducted on February 5 through March 17,1996, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violation is listed below:

10 CFR Part 50, Appendix B, Criterion V," Instructions, Procedures and Drawings," states, in part, that " Activities affecting quality shall be prescribed by documented instructions, procedures, or drawings, of a type appropriate to the circumstances and shall be accomplished in accordance with these instructions, procedures, or drawings."

Administrative Control Procedure 1408.9, " Control of Transient Equipment / Materials," Step 3.7(2),

provides a list of unacceptable plant elements for the restraint of unstable equipment, such as conduit, small bore pipe (less than four inches), heating, ventilation, and air conditioning (HVAC) duct or related hangings, and safety-related equipment.

Contrary to the above, between February 10 and March 6,1998, the licensee failed to follow Administrative Control Procedure 1408.9, Step 3.7(2). Unstable transient equipment / materials were restrained to unacceptable plant elements: a rolling cart was restrained to a conduit in the control room back panel area, panel doors were restrained to a conduit in the reactor recirculation motor generator room, two rolling carts were restrained to control building chiller safety-related piping, two high efficiency particulate air filter units were restrained to HVAC hangers, two carts were restrained to small bore piping in the reactor building, a ladder was restrained to a conduit in the reactor building, and two light bulb boxes and a ladder were restrained to a conduit in the intake structure. 1 This is a Severity Level IV violation (Supplement I).

Pursuant to the provisions of 10 CFR 2.201, Duane Amold Energy Center is hereby required to l submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: j Document Control Desk, Washington, D.C. 20555 with a copy to the U.S. Nuclear Regulatory l Commission, Region til,801 Warrenville Road, Lisle, Illinois 60532-4351, and a copy to the NRC Resident inspector at the Duane Arnold Energy Center within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and shoula include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation or severity level, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Your response may reference or include previously docketed correspondence, if the correspondence adequately addresses the  ;

required response. If an adequate reply is not received within the time specified in this Notice, l an order or a Demand for Information may be issued as to why the license should not be l modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.
