NOTICE OF VIOLATION l ICI Tracerco Docket No. 150-00042 ,

l During an NRC inspection completed on April 28,1998, a violation of NRC requirements was ,

l identified. In accordance with the " General Statement of Policy and Procedure for NRC '

Enforcement Actions," NUREG-1600, the violation is listed below:

10 CFR 150.20(a) provides, in part, that any person who holds a specific license from an Agreement State is granted an NRC general license to conduct tha same activity in l offshore waters, provided that the provisions of 10 CFR 150.20(b) have been met.

10 CFR 150.20(b)(1) requires, in part, that any person engaging in activities in offshore .

waters, shall, at least 3 days before engaging in each such activity, file four copies of j NRC Form 241, " Report of Proposed Activities in Non-Agreement States", with the Regional Administrator of the appropriate NRC regional office, l

Contrary to the above, on January 10-13,1998, ICI Tracerco, a licensee of Texas, used licensed materials in offshore federal waters, without filing Form 241 with the NRC.

This is a Severity Level IV violation (Supplement VI).

l Pursuant to the provisions of 10 CFR 2.201, ICI Tracerco is hereby required to' submit a written r

statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control l Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region IV,611 Ryan Plaza Drive, Suite 400, Arlington, Texas 76011, within 30 days of the date of the letter

' transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violations, or, if contested, the basis for disputing the violations, (2) the corrective steps that have been taken i

and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Your response may reference or include previous docketed correspondence, if the correspondence adequately addresses the required response. If an adequate reply is not received within the time specified in this Notice, an order or a Demand for information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where j good cause is shown, consideration will be given to extending the response time.
