NOTICE OF VIOLATION Entergy Operations, Inc.

50-458 River Bend Station License No.: N.F.-47 During an NRC inspection conducted on November 1 through December 12,1998, one violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violation is listed below:
Technical Specification 5.4.1 states, in part, that written procedures shall be established and implemented covering the applicable procedures recommended in Regulatory Guide 1.33, Revision 2, Appendix A, February 1978. Regulatory Guide 1.33, Revision 2, Appendix A, February 1978, Section 7.e(2), recommends procedures for radiation protection surveys. Procedure RSP-0213," Control and Handling of Radioactive Materials", Revision 11 A (a procedure for radiation protection surveys),
states that material can be unconditionally released if loose surface beta-gamma contamination levels are less than 1000 dpm/100 cm2 Contrary to the above, on or about October 22,1997, radiation protection technicians unconditionally released one container with two items contaminated above the limits specified in Procedure RSP-0213. A yellow cloth cover had loose surface beta-gamma contamination levels of approximately 3000 dpm/100 cm2 and a floor mat had contamination levels slightly over 1000 dpm/100 cm2 This is a Severity Level IV violation (Supplement IV) (458/9820-01)
The NRC has concluded that information regarding the reason for the violation, the corrective actions taken and planned to correct the viott. tion and prevent recurrence, and the date when full compliar ce was achieved is already adequately addressed on the docket in NRC Inspection Report 50-458/98-20. However, you are required to submit a written statement or explanation pursuant to 10 CFR 2.201 if the description therein does not accurately reflect your corrective actions or your position. In that case, or if you choose to respond, clearly mark your response as a " Reply to a Notice of Violation" and send it to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555 with a copy to the Regional Administrator, Region IV, and ~a copy to the NRC Resident Inspector at the facility that is tha subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).
If you contest this enforcement action, you should also provide a copy of your response to the Director, Office of Enforcement, United States Nuclear Regulatory Commission, Washington, DC 20555-0001.
