ENCLOSURE 1 NOTICE OF VIOLATION Entergy Operations, Inc. Docket Nos.: 50-313 Arkansas Nuclear One 50-368 License Nos.: DPR-51 NPF-6 During an NRC inspection conducted on June 21 through August 1,1998, one violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violation is listed below:

Unit 1 Technical Specification 6.2.2 states, in part, that each on-duty shift shall be composed of at least the minimum shift crew composition shown in Table 6.2-1. Table 6.2-1 requires two senior reactor operators and two reactor operators on watch when the plant is above cold shutdown.

Unit 2 Technical Specification 6.2.2.a states that each on-duty shift shall be composed of at I least the minimum shift crew composition shown in Table 6.2-1. Table 6.2-1 requires two senior reactor operators and two reactor operators on watch when the plant is operating in Modes 1 - 4.

10 CFR 55.4 states that " Actively performing tho functions of an operator or senior operator j means that an individual has a position on the shift crew that requires the individual to be  !

licensed as defined in the facility's technical specifications, and that the individual carries out and is responsible for the duties covered by that position."

10 CFR 55.53(e) states, in part, that, if a licensee has not been actively performing the  ;

functions of an operator or senior operator, the licensee may not resume activities authorized l by a license issued under this part.

Contrary to the above, between July 1,1997, and July 9,1998, four Unit 1 senior reactor operators, five Unit 2 senior reactor operators, one Unit 1 reactor operator, and five Unit 2 reactor operators resumed activities authorized by a license without actively performing the functions of a reactor operator or senior reactor operator in a position defined by the facility's Technical Specifications. On these occasions, the minimum shift manning requirements specified in Units 1 and 2 Technical Specification 6.2.2 were not satisfied.

This is a Severity Level IV violation (Supplement I) (50-313/9806-01; 50-368/9806-01).

The NRC has concluded that information regarding the reason for violation, the corrective l actions taken and planned to correct the violation and prevent recurrence, and the date when full compliance was achieved is already adequately addressed on the docket in Enclosure 2 of this report. However, you are required to submit a written statement or explanation pursuant to l 10 CFR 2.201 if the description therein does not accurately reflect your corrective actions or j your position.
