I. INTRODUCTION The purpose of this testimony is to respond to those I
contentions that concern the adequacy of plans and resources l for the timely, accurate and effective dissemination of information to the general public regarding an accident at Seabrook Station. In addition, this testimony will address l
those contentions which allege that the Seabrook Station 1988 i FEMA Graded Exercise (the Exercise) failed to demonstrate the I workability or adequacy of these plans and resources for dissemination of information to the general public.
) Specifically, this testimony will address the following paraphrased contentions:

The above contentions and their bases will be specifically addressed in Section V of this testimony.
Sections II, III and IV of the testimony will generally discuss the resources, procedures and concepts for public
) information dissemination embedded in the offsite radiological emergency response plans.
4 II. DESCRIPTION OF PUBLIC INFORMATION RESOURCES AND PERSONNEL i A. Media Center
- 1. Facility and Equipment To ensure the unified, prompt and accurate dissemination of instructions and information to the general public and any
)
necessary media feedback, a Media Center has been established i
l i by NHY. It is located at the Newington Town Hall in Newington, NH approximately 3-4 miles from the Seabrook Station Emergency Operations Facility (EOF). It provides a centralized location and facilities for the issuance and coordination of news media releases issued by NHY and the i various Federal and State agencies. It also provides a ;

centralized facility where the various response organizations can deal with rumors or other misinformation in the public domain that can be readily corrected through subsequent news releases or briefings. The Media Center has been established to effectively facilitate the dissemination of information to the media without the media interfering with emergency response functions.
The Media Center has a media briefing room available to accommodate about 200 people. It also has equipment available needed for the typing, copying, telecopying, )
I displaying and processing of media information by the Media Center staff. Meeting rooms and telephones will be available to receive and transfer information to and from the Media Center. SPMC, Figure 5.2-11. The Media Center has been established to assure that adequate resources are available for the timely and effective dissemination of a vast amount I
of emergency information which likely will result if an accident occurs at Seabrook Station. However, the functions I and the process embedded in the SPMC for Media Center
> I operations also assure that consistent and accurate

! 2. Staffing and Functions I
The Media Center is activated and staffed at the ALERT level. The Public Information Coordinator (PIC) is the official spokesperson for the NHY ORO at the Media Center.

The PIC is responsible for the dissemination to the media of
)
news releases and EBS messages and is the assigned ORO I i
individual designated to coordinate and participate in the news briefings at the Media Center. These functions also require the PIC to interface with utility, State, and Federal i public information officials, thus ensuring his overall familiarity with the emergency conditions and the information
)
being issued. How news releases are prepared by the Public Information Staff and coordinated with and through the PIC for dissemination is discussed in Section III, pages 17-18 of I this testimony. This section also provides details on the preparation and coordination of EBS messages. The PIC is also provided information regarding rumors or misinformation so that there is feedback concerning the accuracy of the information being released through the media. These functions and processes concerning emergency information will maximize the consistency of that information. Rumor Control is also discussed in Section III of this testimony.
The Seabrook Station Emergency Response Organization's (ERO) Emergency News Manager conducts news briefings with the media at the Media Center. The Emergency News Manager acts as the moderator at the news briefings and directs the briefing or questions to the appropriate utility or state official for response. He and the Media Relations / Rumor Control Liaison at the Media Center interact with the PIC to

ensure that inaccuracies, if any, in the news releases are 4 corrected by subsequent news releases, EBS messages, or through news briefings. The ERO, through its Technical Advisor at the Media Center, is responsible for receiving ,
updated plant status information from the EOF Technical Advisor so that it can be discussed, if appropriate, at the news briefings. A similar function is performed by the ERO Health Physics Advisor at the Media Center with respect to radiological information.
B. Joint Telechone Information Center (JTIC) i
- 1. Facility and Equipment The JTIC is located in a separate building adjacent,to i
the EOC in Newington. The JTIC is equipped with the necessary communications links and equipment to carry out its functions as defined by the SPMC and described below.
- 2. Staffing and Functions The JTIC operates and functions as a combined facility i
staffed by personnel from the NHY ORO, NHY ERO and State of l
- New Hampshire (SONH). SPMC, Section 3.7.3.C. This combined staffing approach ensures coordination of information with the various response organizations. l
[ The function of the JTIC is to provide accurate and l I !
current information in response to telephone inquiries received from the public and from the media. As part of the process of responding to inquiries, the JTIC provides a

l public information " steering mechanism" by providing for the 1
identification and reporting of rumors or false information.
Once identified, this information is promptly documented, j i
reviewed and reported from the JTIC to the Media Center. ,

This information is then made available to the public information staff at the Media Center and the EOC for h consideration in the formulation of news releases and/or EBS messages. The rumor control process is described more fully in Section III.B.3, suora.
Radio and television broadcasts are also monitored at the JTIC. Equipment is available to record broadcasts if necessary for further review. News releases will contain information regarding the appropriate JTIC telephone number for public or media inquiries.
JTIC positions and staffing are described as follows:

in part of a building which also houses the EOF and the State i of New Hampshire Incident Field Office (IFO). This building ,

as the command center for-directing and controlling the offsite emergency response, including the preparation and dissemination of new releases and EBS messages. It serves as the location for the following response activities:

- Emergency' Preparedness Advisor These assistant directors, advisors and coordinators will be responsible for providing the NHY Offsite Response Director with accurate and timely assessments of the accident situation and the operational status of the NHY Offsite Response Organization and facilities. In turn, the NHY Offsite Response Director will keep State and Federal officials informed of response activities. At the EOC, the Public Information Advisor (PIA)Lis responsible for the preparation, coordination, and dissemination of public information, including news releases, developed by the NHY ORO. The Public Notification Coordinator (PNC) is responsible for the development and coordination of EBS messages. These functions are discussed below.

III. COORDINATION OF EMERGENCY INFORMATION MATERIAL l l
l A. Description of Emeraency Information Material )
\ l The public, including the media, obtains official information concerning a Seabrook Station emergency from three sources: (1) EBS messages, (2) news releases, and l
5 (3) generic, factual information available from JTIC persortnel.
EBS messages which will be broadcast to the public are l
either prerecorded, prescripted or modified, as appropriate, l
from the prescripted messages. This use of and development l from these prescripted messages ensures that the EBS messages will be consistent, accurate, clear and specific, among other attributes. Prescripted messages, Attachment A hereto, will be incorporated as part of IP 2.13 in the next revision of the SPMC. These prescripted messages are based on similar messages in the New Hampshire Radiological Response Plan (NHRERP) which the ASLB concluded were adequate (LBP-88-32, 1 7.96). The EBS messages were developed in accordance with the criteria in NUREG-0654, II.E.5 and the guidance contained in FEMA REP-11, "A Guide to Preparing Emergency Public Information Materials," June 1987. If, at the time of an emergency, modifications to the prescripted EBS messages are considered appropriate, SPMC procedures for development and approval, as discussed below, ensure that adequate and effective information is relayed to the public.

Prerecorded messages will be maintained at the ORO EBS radio station. Upon authorization of the Commonwealth, the PNC will contact the ORO EBS station and advise it of the title of the prerecorded advisory message appropriate for broadcast, or advise them that the authorized EBS message for broadcast will be telecopied to them. The station is also notified of the frequency of the broadcast. IP 2.13 at 5.1.11.C.
News releases, including information provided to the media at press briefings and over the telephone at the JTIC, are developed to give up-to-date information regarding plant status, emergency operations, and response actions underway affecting the public. SPMC procedures have been developed to ensure that news releases address some or all of the items listed below if appropriate to the message (see IP 2.12, at 5.2.2.B):

After the EBS messages are approved by the NHY Offsite i

The PNC's procedure, however, includes a cautionary note that I
public notification must occur within 15 minutes of the Massachusetts Governor's or his designee's authorization to notify the public. IP 2.13 at 5.1.11. This process recognizes the importance of timely public notification'and ensures that all organizations are aware of each other's immediate and impending actions.
After the EBS messages undergo the requisite coordination and approval process for broadcast, procedures are in place to ensure consistency and accuracy of broadcast. <
IP 2.13 directs the PNC to provide a copy of each broadcast.

I development of news' releases by the Public Information Staff, thus assuring consistency of the news releases with EBS messages. The PIA also provides the EBS messages to the b Media Center for use as a news release, and to the JTIC for use by the Media Relations and Rumor Control Assistants.

l Media Center and telephone responses at the JTIC are consistent with EBS messages. A graphical depiction (flow chart) of Massachusetts emergency information is set forth in Attachment B hereto.
Overall coordination of EBS messages is further ensured by the fact that the Media Center provides the necessary facilities to allow representatives from each of the principal State, Federal and utility response organizations to interact on publi-c information matters, including EBS broadcasts. In addition, at the JTIC, Media Relations / Rumor
- Control Supervisors of the ORO, ERO and the State of New Hampshire review all news releases, bulletins and EBS messages prior to distributing them to their staff. These processes provide a nechanism whereby inconsistencies or inaccuracies in an EBS message would be noticed and the
- issuing organization immediately contacted for corrective action.
- 2. News Releases As stated in.Section II.C.2, suora, the PIA is responsible for the preparation and issuance of news releases

j and responding to rumors or misinformation. The PIA obtains approval of all news releases developed by his staff from the i
NHY Offsite Response Director and then directs the
- transmittal of the approved release to the Media Center and the JTIC. IP 2.12 at 5.1.5.C. This assures that the timing and content of news releases are coordinated with EBS I
messages. If a bulletin news release is to be issued, the j PIA verbally communicates the information to the PIC and provides the content via a Bulletin Release Verification Form j i
to the Media Center and the JTIC. IP 2.12 at 5.1.5.D.2 and 5.1.5.D.3.
Upon receipt of an approved news release from the PIA, the PIC reviews it and coordinates with the Seabrook Station Emergency News Manager and Federal and State Public Information Officers prior to briefings and dissemination.
IP 2.12 at 5.3.4. The PIC, in turn, keeps the PIA informed of feedback from the briefings and provides copies of all news releases and EBS messages issued by other organizations at the Media Center to the PIA and the JTIC. IP 2.12 at i

In addition to the prompt distribution of EBS messages and news releases from the PIA to the Media Center and the I JTIC, the SPMC also provides for the coordination of information between the Media Center and the JTIC to ensure that the Media Relations and Rumor Control Assistants have l
j accurate and timely information for responding to media and public inquiries. IP 2.12 at 5.5.4. Rumors or I misinformation are fed back to the Media Center to be addressed if appropriate in future press briefings.

Rumor Control To ensure consistent information is disseminated to the public and to ensure coordination of information with other response organizations, the SPMC provides for rumor. control or control of misinformation through the personnel and resources at the JTIC. The Media Relations and the Rumor Control' Assistants are instructed to respond to inquiries by using information from approved EBS messages and news releases, as well as the pre-approved factual information in their position packets. The Media Relations Assistants are also assigned to monitor television and radio broadcasts for misinformation. Misinformation is reported to the Media Relations / Rumor Control Supervisors at the JTIC who, in turn, transmit the information to the Media Relations / Rumor Control Liaison at the Media Center for immediate action, if
! appropriate, by the PIC at press briefings. IP 2.12 at 1 5.5.6.D, 5.4.7, 5.3.6. Sg.g also, Attachment B hereto.

and appropriate to respond to public inquiries using official approved information, it might be necessary for the PIA to t develop and disseminate supplemental information regarding the emergency and response activities to counter any misinformation broadcast or issued by the news media or to 1 dispel persistent public rumors. Since the PIA and the

Public Information Staff are located in the EOC, they are in !
the best position to develop news releases and other accurate information because they have access to all the latest plant and emergency response information, and they can effectively j coordinate the response through appropriate ORO, ERO, and State officials co-located in the EOC. IV. CONCEPTS FOR EFFECTIVE EMERGENCY INFORMATION f The basic concepts used .fe evaluating the effectiveness I
of warning messages, including the prescripted EBS messages in the SPMC are as follows:
- First, the content of an EBS message or news release should provide information which is specific, I consistent, accurate, certain and clear about the risk, the I
risk location, public response guidance, and response timing.
Second, the messages should be repeated often in a i pattern.
- Third, the source of the message should be identified and, when possible and appropriate, the source should be a mix of persons and organizations.
- Fourth, the channel of communication to the public should be diverse as is practical.
EBS messages should be well-focused and need not provide an explanation of the inter-organizational chart regarding emergency management and response. Messages should instead focus on the factors of risk, its location, guidance about response and response timing. The messages in the SPMC have a correct content focus and it should not be diverted except when necessary as determined by the PNC. Additionally, all EBS messages intended for issuance upon declaration of a Site ,
Area and/or General Emergency, including all messages recommending protective actions, state that the New Hampshire

An emergency message which is repeated frequently is
! more likely to be confirmed in the mind of the listener, and

confirmed messages are more likely to be believed. The EBS messages in the SPMC are designed to be broadcast every 15 t
minutes. However, it is not necessary to repeat emergency messages every 15 minutes, especially in situations where the emergency status remains relatively unchanged over a period of days. It should be emphasized that messages in the SPMC
{ are sample messages which can be altered in an emergency to suit actual circumstances and events.
Consistent with these basic concepts, the prescripted EBS messages in the SPMC identify the Massachusetts Governor as the source of emergency information being disseminated.
Although not ideal, this is an accurata ascription of the source as these messages would only be brcadcast upon authorization from the Governor or his designee. It is not necessary for these messages to further explain who and what is " controlling" and " directing" the emergency response.
Even though it is not necessary for the message = "o discuss the relationship between ORO and the State at,'/o local governments, language in these messages indicates that the ORO and the Coun.7nwealth are in communication regarding the I
I incident, clearly reflecting an emergency response relationship between the two entities.
In addition to accurate and effective messages, j communication systems and processes must be in place to
(
assure that the emergency messages and information get to the right people / organizations in a timely manner for an effective response. Similarly, the communications systems and processes must assure adequate and timely feedback, if necessary, for corrective actions. The SPMC has been designed and developed to assure simple, redundant and flexible communication flows between the various NHY, State and Federal organizations. Communication processes must be simple so that information flows are timely -- that is, the information should not be lost or delayed in a bureaucratic structure. Communication processes must be redundant so that a failure in one process or system does not result in a total loss or delay of needed information. . Communication processes must be flexible so that information can be developed, coordinated and disseminated in accordance with the circumstances -- that is, a short-circuit or bypass of a
" normal" process may be in order in some' circumstances.
The SPMC provides simple primary and backup communication systems and processes for emergency information flows. With respect to EBS messages, they are provided s:
(1) ORO EBS stations, (2) the Media Center, and (3) the JTIC l
by either telecopy or hand-delivery. Accuracy of delivery is I assured by feedback to-the Media Center or the JTIC. With respect to news releases, they are provided to the Media i Center and the JTIC by telecopy or hand-delivery. Feedback i
also comes to either the r!edia Center or the JTIC. Ring down i circuits and commercial phone lines also oxiFt'between the JTIC and the Media Center, and between the Media Center and
'the EOC for primary and backup communications. Corrective i
actions, if necessary, can be ac.:omplished orally at news briefings or through telephone responses at the JTIC, or by subsequent news releases or EBS messages.
Dr. Carter has not oeen careful nor comprehensive in developing the criteria with which he would judge the i adequacy of the SPMC and exercise EBS messages. Some illustrations follow.
On page 7 of his prefiled testimony, Dr. Carter has dismissed the list of important emergency public information factors provided in earlier testimony. He then offers a
) substitute list of ten factors on pages 7 through 10 of his I
testimony. This list is taken from a publication by Sorensen, Vogt and Mileti.
We consider the list of factors in prior testimony to be more comprehensive than the substituted list by Dr. Carter.
The reader was cautioned in the publication cited by Dr.
Carter. It stated that the ten factors were limited to l

l general findings, and that it was not the purpose of that publication to go into the topic in depth.
Moreover, the list of ten factors presented by i
Dr. Carter purports to represent the list provided in the referenced publication. It does so accurately in reference to some points. It distorts what was said in reference to other points. It also suggests that things were said in the publication which were not said.
Dr. Carter then reviews some conclusions from a book by Perry, Lindell and Greene on pages 11-15 of his testimony (See Ronald W. Perry, Michael K. Lindell and Marjorie R.
Greene. 1981. Evacuation Plannina in Emeraency Manacement, ;

l' Lexington, Massachusetts: Lexington Books). Dr. Carter i
states on page 12 of his testimony that this research identified perception of severity of impact and perception of proximity to the area of impact as the two key elements in a person's perception of personal risk curing emergency j warnings. On pages 13-14, Dr. Carter states that this research identified three factors which facilitate taking i
protective actions. These were identification of an appropriate and effective action, the existence of an individual or family emergency plan, and a social context in l
which the family is together or otherwise accounted for during the emergency.

I Reliance on the results of one publication (particularly when many others exist) is dangerous in the social sciences. i Some factors found to be important in one setting may not apply in another. The relationship between two variables can change when others are introduced. (Perry and his colleagues 7 did not examine all or even most of the factors that impact public risk perception and response in emergency warning j settings.) For example, it has been found that family unity facilitated protective actions in the 1965 Denver flood, but it had no impact on protective actions during the 1972 Rapid City flood. It is inappropriate to pick statistical findings from one emergency or one study (the Perry, at al.
publication was on four flood events), ignore all other studies, and then make generalizations across time and space as Dr. Carter has done with the Perry, et al. publication.
J Moreover, Dr. Carter has not done a close reading of some of the Perry, Lindell and Greene text. For example, j Dr. Carter states on pages 13-14 of his testimony that one of the three factors which Perry at al. found to facilitate protective action was "a social context in which the family is together or otherwise accounted for at the time of the

emergency." The Perry gt al. book suggests that the authors themselves thought they had insufficient data to fully
- examine the hypothesis of family unity on responses (see page J
- 45) but they were able to conclude that reuniting family
i i
members after evacuation would be useful to address in planning (see pages 161-162). Although Perry gt 31. do not dismiss family unity as unimportant, it is hardly one of three factors revealed in their' data set as directing protective actions.
Dr. Carter has suggested that the list of factors presented in 1987 Applicants' testimony (distilled from all available publications on public response to warnings) be disregarded on the grounds that it is too abstract or theoretical. He suggests that it be replaced with a ten point checklist which comes from a publication by Sorensen, Vogt and Mileti in which the reader was cautioned that the list ~1as limited since it was not the purpose of the publication to go into depth on the topic. The ten point I
list is then presented (sometimes correctly and sometimes not, other times the authors are attributed with saying things that are not said). Then something called the Perry model is presented. The alleged model comes from one of Dr. Perry's earliest works. The model presented accurately reflects some of the findings in the Perry 31 al.
publications, distorts others, and hardly bears resemblance to the model which Perry at al. proposes as a summary of
/
their own work (see pages 119, and Chapter 8). .
l Our conclusion is simply that Dr. Carter has not been careful nor comprehensive in developing a scientific basis t
l for the criteria he proposes as a devise with which to evaluate the SPMC and exercise EBS messages. This has led to some incorrect evaluation criteria in the " checklist on Level of Detailed Information'" which he offers or pages 16-19 of his testimony. For example, on page 19 of his testimony he proposes that ". . . messages disseminated to the Media j Center should be disseminated through EBS." The amount of information or messages which could be disseminated in the information and detail-rich environment of the Media Center is large. Messages could come through press conferences, press releases and other ways. Surely Dr. Carter would not have the Media Center information distribution function ,
1 constrained by the limited capacity of the EBS system; or conversely, so overburden the EBS system with details that important EBS information (for example, protective action recommendations) is obscured, EBS messages cannot be frequently repeated, or expect a radio station to relinquish
, all of its air time to the EBS function.
V. DISCUSSION OF SPECIFIC CONTENTIONS The following are specific responses to the admitted contentions concerning the adequacy of information disseminated to the public in the event of an emergency at Seabrook Station.

' the older population, or other particular characteristics.
Indeed,sthe messages are designed to convey accurate.and' factual information in-a clear and concise manner. The messages focus on the factors of risk, its location, guidance I i
about response to the-risk, and the timing of that response.
This type of information'also can-be developed for subsequent' news releases based on public inquiries or rumors. The j process for the development of this information and its dissemination is discussed in Section III, supra.
HDr. Carter has asserted that the SPMC prescripted EBS messages contain a number of fundamental problems which occur i
repeatedly throughout the messages. First, he asserts that "a large number of the messages consistently fail to give i-instructions to all members of the public within the EPZ" L

I (Carter, page 20). In essence, this criticism concerns
$ messages informing one group in the EPZ (e.g., boaters, beach and wildlife refuge visitors, and residents of distinct towns in the Massachusetts EPZ) to take protective actions without
/
informing other groups within the EPZ of those actions and why they are being taken. Dr. Carter asserts that this
^
division of instructions creates confusion and anxiety.
The prescriptied messages do give recommended actions to x
all members of the EPZ. These messages are designed to give 7
recommended actions to people in the EPZ based on the risk
- which they face. Everyone in the EPZ is advised to stay I tuned to the EBS station. People in towns are advised to consult emergency information materials sent to their homes or information flyers at beach and recreation facilities. People who would be safe if they sheltered are advised to do a Ei so, and those who should evacuate are so advised.
- Moreover, putting additional information in the EBS
== messages regarding why people who are safe are not at risk would detract from the needed information required to be disseminated to the public who is at risk. FEMA /NRC guidance suggests that warning messages must not be cluttered with extraneous information. Plans for an emergency at Seabrook correctly provide other formats for the presentation of non-h_ EBS relevant information, for example, in new releases and press conferences. N

--- Second, Dr. Carter asserts that the messages must
" contain information relating to "the actual or forecast severity of the release or to the potential health effects of the release" (Carter, page 21). Again, this assertion ignores the reality of a radiological emergency. For E example, it would take too long to calculate actual or
- projected releases in order for such information to be
-B Additionally, it is not effective in most messages. appropriate to include potential health effects in the messages because (a) a majority of the public does not understand the terms or the health effects relating to radiation and an EBS message is not the place for basic I science education, (b) any information relating to potential E health effects may detract from the needed certainty of the message, and (c) we are unaware of any analogous emergency warnings in which the physiological affect of exposure to a - hazard are explained in community warnings, (for example, the I physiological character of drowning in storm surge associated wi +' +
- iandf all of a hurricane) . The content of EBS itassages in a radiological emergency should not permit the public to discount or second-guess the risk. This could detract from the pubic taking the protective actions recommended in the message, g Third, Dr. Carter asserts that the prescripted EBS messages contain no information "on future preparedness t .
i needs" (Carter, page 22). However, as Dr. Carter j acknowledges, the EBS messages do refer listeners to the ,

public information materials for further information and to i t stay tuned to the EBS station or a local radio station. Any l further preparatory information, as Dr. Carter suggests, would be based on speculation regarding the unknown course of ) the emergency. Such speculation is not required for the 1 needed attention and focus to the message. To the contrary, j L this type of speculation would probably induce more of the anxiety and confusion that Dr. Carter wants to avoid. i In sum, Dr. Carter's basic premise regarding EBS message content that "more information is better" although generally , r true, should be limited to relevant information and be based on the realities of a radiological emergency. The content ) and focus of the SPMC prescripted EBS messages are based on 1 f concepts that assure accurate and effective messages during a radiological emergency. JI-35. Basis B alleges that:
"The SPMC makes no provision and provides
) no procedure for coordinating emergency messages with participating and non-participating state and local governments ) as required by NUREG-0654, II.B.7.d and Supp. 1, II.E.8." The SPMC procedures and the processes that provide for the coordination of emergency messages between the ORO and ) appropriate State and local officials in Massachusetts are 1
)
set forth in Section III.B.4 of this testimony. These procedures and processes assure that these officials have ] , r adequate input, knowledge of, and feedback concerning EBS messages and news releases. Dr. Carter contends that the SPMC should take "into
< account" the needed coordination with local officials at the i county and municipal levels in Massachusetts (Carter, page 37). He admits that this coordination planning is ! " difficult" because of the nonparticipation by Massachusetts r
governmental agencies. With respect to the coordination of ) county and municipality input into emergency messages or l information, the NHY ORO coordination with state and local governments is discussed in Section III.B.4. Both the SPMC j and the CERP require local governments to coordinate their public information activities with and through the i Commonwealth, not directly through the NHY ORO. This has been established because state officials need to be directly involved in these activities to assure consistency and accuracy of messages. Hence, Dr. Carter's suggestion of ) direct coordination between ORO and local governments on l j emergency messages would be contrary to both logic and i established procedures. ! ) Dr. Carter also asserts that SPMC provisions are l I
" sparse" regarding the ORO's coordination of emergency b
information with New Hampshire officials (Carter, page 38).

ORO done at the Media Center by the PIC pursuant to SPMC, IP l l y Section 2.12. The SPMC, however, contains numerous provisions for coordination of information between ORO and i State of New Hampshire officials. For example, ORO personnel 1 L are co-located with New Hampshire personnel at the ORO EOC/NH p IFO, at the JTIC, and at the Media Center. This permits 1 coordination of EBS messages, news releases, media briefings, and responses to public and media inquiries. Combined functional drills and exercises provide practical training )- for these coordination processes. CI-35. Basis C asserts: .,
"The messages do not adequately address the issue of their source and do not 3
explain who and what is controlling and ) directing the emergency response. There is no discussion in the messages of the emergency relationship between ORO and the state and/or local governments. See NUREG-0654, Supp. 1, II.E.7." As noted in Section IV, the EBS messages clearly state that the actions being taken in response to the emergency are 1 being carried out by the NHY ORO under authorization from the Governor of Massachusetts. This informs the public that the NHY ORO is controlling and implementing the response, but the Governor has authorized the response. Any further information regarding this relationship between ORO and the State need not be contained in the messages for two reasons.
i ) First, the messages indicate in a precise fashion that the Governor is the source and authority behind the response. I Thus, the public is assured that the State is informed and i l involved. Second, EBS messages should not provide a detailed explanation of the emergency responsibilities of ORO or the State and/or local governments. EBS messages should be well-focused and provide clear and concise information regarding the risk, its location, guidance and response timing. More detailed information concerning the relationship between the Governor and the ORO is contained in the public information ) materials disseminated to the households and businesses in the Massachusetts EPZ. JI-35. Basis D asserts:
"The SPMC provides no adequate procedures
} for ensuring that the emergency messages broadcast to the public correlate with the messages and information provided to the media by the NHY ORO and other officials." The SPMC contains numerous provisions and procedures to assure that the broadcast EBS messages are consistent with information provided to the media and ultimately to the public. First, EBS messages are given to the PIA who is responsible for the development and issuance of news releases. Since the PIA must obtain the approval of the NHY Offsite Response Director prior to dissemination of news releases, timing and content coordination with EBS messages
' .) s' is' assured.- The Offsite Response Director at the EOC must approve both EBS messages and news releases before ) dissemination and, therefore, he is the common link to assure. r l consistency notwithstanding the coordination between the PIA ! and the PNC in the developmental process. Second, EBS messages are provided to the media and the ORO at the Media i Center. Any inconsistencies between the messages and the } news releases would be readily ascertained and could be corrected, if appropriate, in a timely manner before public dissemination. Third, SPMC procedures provide for the i coordination of information between the Media Center and the JTIC. This assures that not only will the Media Relations and Rumor' Control Assistants have accurate and timely information for responding to media and public inquiries, but [ also that they will review the information for accuracy. Any inconsistencies in the information would be discovered in the review-process or subsequently be reported by-the media or the public. Corrective action, if appropriate, could be taken immediately. The rumor control process is detailed in 7. Section III.B.3. Obviously, it is better to discover inconsistencies before dissemination t'o the public and the provisions and procedures embedded in the SPMC provide a good mechanism to discover inconsistencies before dissemination. However, should inconsistent or incorrect information be disseminated 1 4 L I to the public through EBS messages or news releases, the incorrect information can be ascertained through feedback processes at the Media Center and the JTIC so the. correct information can be provided quickly through (1) subsequent I messages or news releases, (2) press briefings, and ?
- (3) telephone information provided through the Media j Relations and Rumor Control Assistants at the JTIC. The
} process chosen to disseminate correct information would ! depend on a number of factors, including (a) the original f format of the information, (b) the seriousness and extent of 3 the incorrect information, and (c) the immediacy of the needed correct information. To be sure, widespread f information of a serious nature would be corrected ( immediately and corrected information would be available Y through all three processes. On the other hand, minor and i isolated misinformation or localized rumors might be corrected only through telephone inquiries at the JTIC in order not to confuse or contradict the correct information being made available to the public through the EBS messages ) and news release processes. i Dr. Carter takes issue with the SPMC procedures that 7 establish a separate entity to develop and disseminate ORO EBS messages -- the PNC -- and a separate entity to develop and disseminate ORO news releases -- the PIA (Carter, page ) 32). While recognizing that there are valid reasons for r i
n designing and implementing a decentralized information organization, Dr. Carter's criticism of a decentralized approach is based on what he terms a " fallacious distinction" between EBS messages and news releases. Id. at 33. In his view, " emergency information is emergency information" and, thus, the processes for development and dissemination should be uniform -- i.e., centralized. Ibid. This, he concludes, would result in more consistent information being i disseminated through the media to the public. The SPMC procedures, however, do recognize a necessary distinction between EBS messages and news releases. EBS messages in a radiological emergency need to be clear, concise and timely. They provide definitive instructions to the public that often require an immediate response. They need to be developed, coordinated, approved and disseminated in an expeditious and effective manner. They do not have the luxury of a 36-hour lead time (or more) that is available for a response to a hurricane. News releases, on the other hand, provide more information to the public and usually can be developed over more time. This distinction regarding the time for dissemination and the content of the message necessitated a division of labor to assure effective I information was developed. However, the development process is not a decentralized approach as alleged by Dr. Carter. EBS messages and news release approval is centralized in the
l l L I' l NHY Offsite Response Director. Consistency in public information is readily assured because the NHY Offsite Response Director must approve all EBS messages and news j releases prior to dissemination. JI-35. Basis E asserts: i r "The pre-established messages set forth in the SPMC at Pro-2.13, Attachments 2- ) 24, may be altered or modified by the } Public Notifications Coordinator. Pro-2.13 at 8. No guidance or training is provided this individual on the essential components of an effective emergency message. As a result, the message (s) actually broadcast may be less effective than those set forth in the SPMC." The PNC is able to perform the EBS message developmental and coordination functions because he has been specifically trained in these functions as part of the ORO Emergency Plan Training Program. SPMC at 2-1, pages 2.1-14; see also Applicants' Rebuttal Testimony No. 20 (ORO Prerequisites and Training) page 28-30. Supplementary training in the concepts and components required for effective emergency information including ad hoc message modification, will be provided to the persons filling the position of PNC. This training stresses the importance of clear, concise messages directed at the public that explains the dangers in terms the public can understand so as to leave no doubt about the existing conditions. A draft training program agenda has been

Finally, i L the close proximity of the Media Center to the EOF and EOC and their equipment assure that information flows will be ) prompt and authoritative sources of information can be readily available that might not otherwise be already available at the Media Center. j Dr. Carter contends that the SPMC procedures for the Media Center are faulty because news releases will be L distributed only to those broadcast media in attendanes at the Media Center (Carter, page 33). However, widespread ) dissemination (both local and national) of news is assured p regardless of attendance at the Media Center because SPMC i procedures require news releases to be provided to AP and UPI wire services (SPMC at 5.6.7, 5.7.2). Therefore, local and national broadcast media stations will have access to all y news releases in a timely manner since virtually all TV and l radio stations receive either or both wire services. The SPMC also provides adequate procedures to ensure I that media inquiries to the Media Relations Assistants at the JTIC will be responded to with official utility and ) governmental information. Current EBS messages issued by the h
utility are provided promptly to the JTIC by the PIA as soon l ac they are approved. Similarly, the PIC provides the JTIC with copies of all news releases and EBS messages issued by other organizations at the Media Center. See also, response to MAG EX-17, Basis C, infra. JI-38. Basis A asserts:
"In the event of an emergency at seabrook, there may exist.several official sources of information, including the State and/or local governments. No provision is made for the coordination of rumor control efforts by these sources. Without a centralized source of information, no rumor control will be effective."
The SPMC rumor control process is described in Section III.B.3 above. While several official sources of information may be utilized depending on the information format chosen, the rumor control process assures the effectivo development, coordination and dissemination of correct information by and through the various sources of information located at the Media Center, JTIC and the EOC. In essence, the EOC acts as the hub of a wheel and all information concerning the emergency response flows to and through various personnel at the EOC. The PIA and the Public Information Staff, located in the EOC, develop, coordinate and disseminate news releases and other accurate / official information. They have access to all the latest plant and emergency response information, and they can effectively
l f i coordinate the response through appropriate ORO, ERO, and State officials co-located in the EOC. Similarly, the PNC, located in the EOC, can provide an identical function with j respect to EBS messages. Thus, the EOC is the conduit or centralized source of all information to be disseminated to the public. JI-38. Basis B asserts:
"The ORO itself will be unable to provide coordinated rumor control. The SPMC provides that the Public Information Advisor shall designate at the time of an emergency, a rumor control staff, and appoint a lead to assign responsibilities, including briefing the staff on the Rumor Control Policy Guide. Pro-2.12 at 5.1.4. The Public Information Advisor is to develop a strategy for responding to incorrect media broadcasts and ,
persistent public inquiries. Pro-2.12 at 5.1.10. The midst of an emergency is not the time to set up the rumor control structure or to develop l strategies for response to rumors." As of Amendment 5 to the SPMC (5/23/88), the Rumor Control Assistants have been designated as permanent members of the ORO. These positions, therefore, are not required to be staffed by the PIA at the time of an emergency as asserted by this contention basis. Similarly, the Media Relations / Rumor Control Liaison and Supervisor are predesignated in the ORO. Since the Rumor Control Staff is predesignated, they receive the requisite ORO training on rumor control procedures and the Rumor Control Policy Guide. i Based on their positions and training, the Rumor Control Staff, directed by the Media Relations / Rumor Control I
} L l-f Supervisor, is responsible for responding to rumors. This responsibility does not reside in the PIA as asserted. JI-38. Basis C asserts:
"The Rumor Control Policy Guide (Pro-2.12, Attachment 1) mandates that only the Public Information Coordinator or individuals he l
designates are to discuss the emergency with the [ media at news briefings. The instructions to the Public Instruction Coordinator (Pro-2.12 at 5.3.10) t direct that person only to " participate" in news briefings. Media briefings are one of the key f tools to be used in keeping the public informed and thereby controlling rumors. These briefings should involve full use of experts and visual and graphic > aids to convey technical information in an understandable manner. The SPMC does not provide for such an approach." l The Rumor Control Policy Guide (IP 2.12, Attachment 14) has been revised to delete any reference to the PIC or the proper functions of any ORO personnel at news briefings. As I noted earlier in Section II.A, the PIC is the official spokesperson for the ORO and its functions at the Media L Center. As such', he is the assigned ORO individual to i initiate and participate in the news briefings regarding ORO response functions or activities. An ERO Technical Advisor > and a Health Physics Advisor are available at the Media Center to coordinate and provide technical / radiological i information from the EOF concerning plant status and j functions for press briefings. The Seabrook Station Emergency News Manager at the Media Center is responsible for } the coordination and dissemination of news releases l
) i l l concerning radiological or technical plant information. In ) addition, the Emergency News Manager can direct media inquiries to the appropriate utility or governmental officials at the Media Center for response at news briefings. Equipment, resources, and personnel are also available at the } } Media Center for necessary visual or graphic aids which might benefit the conveyance of technical information to the media. JI-38. Basis D asserts:
"The SPMC assigns public information personnel
> responsibilities without any guidance as to the manner in which those responsibilities are to be carried out. Information can not (sic) be l effectively communicated to the public unless public information staff are fully informed of developments and have access to technical experts capable of addressing areas of uncertainty. Any plan which does not recognize the public's extraordinary appetite for information and does not specifically assign a role in information I preparation and dissemination to technicians and experts is inadequate." The SPMC recognizes the public's need for and right to [ clear, concise, and prompt information regarding an emergency at Seabrook Station. As indicated earlier, the PIA and the Public Information Staff at the EOC are the focal points for the development, coordination and dissemination of public information through news releases / bulletins on the emergency. The PNC is responsible for the development and coordination of EBS messages at the EOC. The ERO Technical Advisor at the EOC is responsible for obtaining technical information l concerning plant conditions and functions from the Seabrook f

k J 1 l f Station Technical Staff through the interface with the I Seabrook Station EOF Coordinator. This technical information l 1s then made available-for the preparation of public information at the EOC. Technical information is also made available to the ERO Technical Advisor and the ERO Health f Physics Advisor at the Media Center so that it can be incorporated, if appropriate, into the news briefings. l MAG EX-9. Basis A asserts:
"The EBS messages and the news releases actually
> generated during the Exercise were confusing and contained conflicting information. An average member of the public who had heard over the radio l or on television the ORO news releases and EBS messages in sequence would have come away with all kinds of unanswered questions. Confusion would have been generated, for example, regarding . who/what ORO was, what had happened to town police and civil defense, what the role of the State was, what it meant that ORO was " activated," what it I meant to leave the " beach areas" (how far should I go?" "what if I live there?"). Much confusion would have been generated about school children, what schools were doing, and what parents should or should not do (as is more specifically described in MAG EX-10). There was even confusion generated on Day 2 of the Exercise with respect to what people would be let into the EPZ to care for animals. Much confusion was also generated on both days of the Exercise due to the conflicting nature of the ORO and New Hampshire EBS messages and news releases." To the extent that this contention asserts that EBS messages were, in general, confusing because of improper development and inadequate messages, the SPMC conceptual framework for developing clear and concise messages is discussed in Section IV above. The messages identify the

role and relationship of the ORO and the State of Massachusetts. See also discussion on JI-35, Basis C, supra. Providing more information as suggested by this contention would detract from the required message and, ultimately, result in confusion to a large segment of the receiving i population. The amount of detailed information in EBS messages suggested by this contention is not needed for an effective emergency response. In addition, EBS Message #3 which announced the GENERAL EMERGENCY specifically directed attention to the pre-emergency information that was distributed to residents and i businesses in the EPZ. It is in this material that people 1 would find the answers to general questions such as:
"who/what ORO was," "what had happened to town police and Civil Defense," "what the role of the state was" "what it
( meant that ORO was ' activated'," "what it meant to leave the
' beach areas'7" .S_qe Applicants' Rebuttal Testimony No. 7 for i a detailed description of pre-emergency information. EBS l Message #1 also referred people to the pre-emergency j I i information. Thus, at the SITE AREA EMERGENCY, which closed ;
t l the beaches, people were referred to more specific information which might provide the answers to their general l questions concerning the emergency and the responding l organizations. ] h k The issues raised concerning the confusion in the EBS messages concerning the care of livestock in the EPZ are without he91s. ORO News Release #25 and corresponding EBS j Message #8 issued on Day 2 of the Exercise (Attachment C hereto) specifically directed farmers with livestock producing food products on where and how to temporarily re-enter t.3 Massachusetts portion of the plume EPZ to tend to their animals. It also stated that the action had been approved after extensive sampling and analysis of the six Massachusetts communities. This message was clear in that it f pertained to no other animals which may have been left unattended in the EPZ. Furthermore, News Release #25 and EBS Message #8 repeated, and thus reinforced, information ( previously issued to farmers on Day 1 of the Exercise. ORO l News Release #19 (Attachment D hereto) issued on Day 1 of the Exercise told diary farmers within the EPZ to contact NHY officials at access control points for specific instructions for reentering if they had a need to return to their farms. ! The message on Day 2 also directed the food product livestock ) farmers to specified access control points where they would l receive dosimeters and written instructions. If any farmers were unclear with respect to the message, they could either I call the specified number given at the end of the message, or proceed to the access control point. However, farmers generally know which animals should be attended to and thus i l ) would not be confu;ed by the message. For example, grazing animals (e.g., horses, cattle) do not need daily care if food is available whereas poultry and dairy animals require daily } care. The issues raised in this contention basis regarding the conflicting school messages in Massachusetts are addressed in MAG EX-9, Basis B and in Applicants' Rebuttal Testimony No. 18 (School Protective Actions). Additionally, to the extent that this contention asserts that there are inadequate provisions in the SPMC regarding the coordination of the Massachusetts EBS messages and news releases with the New Hampshire messages and news releases, this coordination at the Media Center and the EOC is discussed in Sections III.B.1 and III.B.2 above. MAG EX-9. Basis B asserts:
"The EBS messages and news releases were not accurate in many respects. For example, there was misinformation about the Newburyport schools in ORO EBS #3, as FEMA has noted. Also there was a serious mistake in News Release #15, which said that the overturned lumber truck (described in more detail in MAG EX-13) was blocking traffic on southbound I-95."
The alleged inaccuracy in ORO EBS #3 concerning the Newburyport schools is addressed in Applicants' Rebuttal Testimony No. 18 (School Protective Actions). With respect to the language in ORO News Release #15 which gave the location of the overturned lumber truck as blocking traffic
l on southbound I-95, it is conceded that the description of l I the location was not as clear as it could have been since the j ( location of the truck was on an entrance ramp to southbound I-95. However, this description was not a " serious mistake" r i I as alleged. h To be sure, the mistake could have caused some people l southbound on I-95 to think that their route was blocked at that location. However, if they would have been actually experiencing free-flowing traffic on I-95, they probably would not pay too much heed to the information. Evacuees l l wanting to enter southbound I-95 at the scene of the incident, on the other hand, would have been successfully re-routed by the news release or traffic guides / police to another I-95 entrance to avoid the overturned truck. This fact is confirmed by the FEMA Exercise Report, Applicants' Exhibit 43F, which states (page 224 of 428): "Some traffic had to be diverted to another freeway entrance and the detour description in the message was correct." In any event, the amount of traffic on I-95 that would have been affected by the confusing location description would not have significantly impacted a timely emergency response. Any traffic exiting from southbound I-95 because of the news release would have gone westward or southward away from the EPZ in response to traffic control point directions.

.. approximately1 1900. Under the circumstances, this was not an l unreasonable delay in the dissemination of.the information [ considering'that the information must be conveyed and confirmed in some manner. Upon notification that an impediment had occurred, traffic guides and/or po;tce would

) appropriate rerouting Ls determined at the EOC. While some t [ traffic may have been impacted by the impediment, most
. traffic would have been physically rerouted in an effi ci ent manner in advance of the broadcast. In short, the news of the impediment would not have affected the efficient and coordinated emergency response to the impediment.
l I This contention also asserts that ORO generally lagged behind New Hampshire in the issuance of PARS to the public as depicted in Table 9 of the FEMA Exercise Report (pages 88-96 of 413). This assertion illustrates a misconception by the Interveners. I In a real emergency, PARS will depend on the risk to the i l affected public. Recommendations to evacuate a specific l population, for example, will depend on the existing and : projected risk of exposure. That risk is location and time specific depending on meteorological conditions, distance from the release, and other factors concerning the status of response functions. These factors pertaining to risk are built into the Exercise scenario. Thus, communities in New Hampshire might be evacuated sooner than communities in Massachusetts depending on meteorological and distance ( factors. The Exercise scenario indeed required communities in New Hampshire to take protective actions sooner than communities in Massachusetts based on the plume trajectory. Thus, EBS messages reflecting the PARS were issued sooner in New Hampshire than in Massachusetts. This was consistent with the Exercise scenario and found to be adequate by FEMA. See also Applicants' Rebuttal Testimony No. 26 (Protective Action Recommendations Made by NHY ORO During the Exercise). FEMA found no deficiencies in the demonstration by ORO ) of Objective #13:

" Demonstrate the ability to coordinate the formulation and dissemination of accurate information and instructions to the public in a timely fashion after the initial alert and notification has occurred."
In the FEMA Exercise Report (page 223 of 428), FEMA stated that " Instructions (EBS messages) were formulated, approved, and distributed according to the system described in the plan." HAG EX-9, Basis D asserts:
"The timing and content of ORO's public information l was not coordinated in any systematic way with the public information (sic] being released by New Hampshire. This would have led to further confusion and mistrust. Comparison of the messages released at about the same time by NH and ORO reveal numerous differences that needed to be resolved and were not. The process for .
coordinating the information released was shown to be ad hoc and therefore inadequate." The process by which the ORO and the State of New Hampshire coordinate the dissemination of emergency information at the Media Center and the EOC is described in Sections III.B.1 and III.B.3 above. That process discloses that coordination does exist between ORO and the State of New s- Hampshire before EBS messages or news releases are disseminated to the public. ) EBS messages for Massachusetts are developed by the Public Information Staff in the EOC and are coordinated with the New Hampshire EOC Operations Officer in the Concord EOC as well as New Hampshire officials in the EOC prior to final l 1 i approval by the NHY Offsite Response Director. Overall coordination of EBS messages is further ensured by the fact that the Media Center provides a mechanism and a facility for representatives of the principal State, Federal and utility response organizations to coordinate and interact on public information matters. In addition, representatives of the ORO, ERO and the State of New Hampshire review all news releases and EBS messages at the JTIC prior to distributing them to their staff. This provides another process for the review, coordination and correction, if necessary, of EBS messages and news releases. MAG EX-17. Basis C asserts:
"During the exercise, ORO personnel responded to various inquiries from the public. As is shown in l
the following examples, their responses demonstrated ORO's inability to dispel rumors, to correct misinformation, to provide necessary, l accurate and timely information to the public and i to ensure that such information is coordinated and non-conflicting. These examples of repeated errors demonstrate a fundamental flaw: Inquiry / Rumor Memos ("IRM") logged at the following times with the following callers: 1:30 (Brown); 2:00 Randolph; (no time) (Clark) ; 3:18 (Collins) ; 3:30 (Lynn); 4:22 l (Crand); 1:10 (David); 2:45 (Sanders); 3:10 ) (Bradshaw); 6:12 (Frances); 7:02 (Stone); 7:10 . (McGuire) ; 16:40 (Jones)." } The process of handling misinformation and rumor trends is described in Section III.B.3 of this testimony. The rumor l control process is designed to ensure that the Media Relations and the Rumor Control Assistants respond to media or public inquiries by using only information from approved 1 I
EBS messages and news releases, as well as the approved-factual information in their position packets. While these i Assistants should attempt to be responsive to the inquiry, they are instructed to respond by using of ficial information. They should not speculate or provide'any information other than the official information or reasonable inferences from that information. This assures that information given to inquiries will be clear, concise, accurate, and current. FEMA assessed the rumor control process during the Exercise in its evaluation of objective 15 which states:
" Demonstrate the ability to establish and operate rumor control in a coordinated and timely fashion."
The FEMA Exercise Report (pages 228-229 of 428) - concluded that:
"The New Hampshire Yankee Offsite Response Organization demonstrated the ability to establish and operate rumor control in a coordinated and L
timely fashion." The JTIC was established adjacent to the NHY ORO EOC for the conduct of rumor control operations. The facility was staffed by rumor control assistants from the NHY, NHY ORO, and the State of New Hampshire. As many as six calls could be handled simultaneously. All of the staff were well informed and were generally kept up to date on I exercise-events.- All of the staff performed well I in responding to calls and were informative, helpful, and sympathetic. A written record was L made of each call, including a brief synopsis of ) the caller's concern. Calls were referred to the supervisors when a question or problem required follow up. The supervisors in turn were very responsive in locating the required information or help and calling back the individuals.

l Careful attention was paid to identification of rumor trends. The staff and supervisors cooperated in detecting-trends in the calls.. If an. . . (sic). . . bring it to the attention of the . supervisors. The NHY ORO supervisor also kept a l running log of the calls, sorted by topic, to help i identify rumor trends. Any such trends detected were promptly brought to the attention of the liaison in the Media Center. , J i While MAG EX-17C makes a blanket statement that ORO 1 l efforts to respond to public inquiries " demonstrated a i fundamental flaw," a closer look at the Inquiry / Rumor Memos i ("IRM") listed in the contention'and shows the following: a) Sufficient explanation to questions with respect to identity of traffic guides at intersections. (Carlson from Amesbury at 1320) b) Dispelled fears of the safety of relatives within the EPZ. (Collins at 1518 and James at 1630)
- c) Correct advice to person who wanted to return to L
the EPZ for personal effects (Lynn at 1530) d) Correctly channeled media requests. (Sanders at 1445, Bradshaw at 1510, Stone at 1902, and McGuire i at 1910) { i l In addition, the IRMs show that often times the RCAs would ) read an appropriate News Release to answer questions of the f [ callers. (Carlson at 1320 and Collins at 1518). The alleged inaccuracy of ORO News Releases #6 and #7 concerning the PARS for Salisbury and Amesbury Schools and 1
1 school children is addressed in Applicants' Rebuttal Testimony No. 18 (School Protective Actions). To test the i JTIC process regarding misinformation, the FEMA RAC chairman and the NHY ORO Exercise Director had the Control Cell place calls to the JTIC requesting _ clarification of the information in the news releases. The rumor control process described in Section III.B.3 worked as designed, and clarifying information was made available to the JTIC and in a subsequent news release and EBS message disseminated approximately one hour after News Release No. 7 was issued.
