4 NOTICE OF VIOLATION Commonwealth Edison Company Docket Nos. 50-454; 50-455 Byron Station, Units 1 and 2 License Nos. NPF 37; NPF 66 During an NRC inspection completed on September 12,1997, two viofations of NRC requirements were identified. In accordance with the " General Statem%t of Policy and Procedure for NRC Enforcement Actions," NUREG 1600, the violationt are listed below:

1. Licensee technical sp9cification 0.11 requires that procedures for portonnel radiation protection be pr3 pared consistent with the requirements of 10 CFR 20 and shall be approved, maintained and adhered to for all operations involving personnel radiation exposure.

Radiation Protection Procedure BRP 5000 7, revision 7," Unescorted Access To And Conduct in Radiologically Posted Areas," dated Jum 28,1990, step 3.1 requires workers to wear protective clothing and respiratory equipment properly wherever either is required by signs, Radiation Work Permits (RWPs), Radiation Protection personnel, or procedures RWP No. 970008,

  • Routine IM Activities, Non Outage," requires that the worker don protective clothing when entering posted contamination areas.

Contrary to the above, on August 25,1997, a worker entered a posted contaminated area without the required protective clothing. (50-454/97017-01 and 50-455/97017-01)

This is a Severity Level IV violation (Supplement IV).

2. 10 CFR 20.1902(a) requires that the licensee post each radiation area with a conspicuous sign or sluns bearing the radiation symbol and the words " CAUTION,

, RADIATION AREA." 10 CFR 20.1902(b) requires that the licensee post each high radiation area with a conspicuous sign or signs bearing the rad!ation symbol and the words " CAUTION, HIGH RADIATION AREA" or " DANGER, HIGH RADIATION AREA."

Contrary to the above, c'1 January 24,1997, an area inside the 2A containment spray pump room, a high radiation area with a radiation dose rate in excess of 100 millirem in one hour at a distance of 30 centirt.eters from the radiation source was not posted with a sign bearing the radiation symbol and the words " CAUTION, HIGH RADIATION AREA" or " DANGER, HIGH RADIATION AREA." Also, on August 4,1997, the 2B letdown heat exchanger room, a radiation area with a radiation dose rate in excess of 5 millirem in one hour at a distance of 30 centimeters from the radiation source was not posted with a sign bearing the radiation symbol and the words " CAUTION, RADIATION AREA." (50-454/97017 02 and 50-455197017-02)

This is a Severity Level IV vlotation (Supplomant IV).

Notice of Violation 2 For Violation Number 1, the NRC has concluded that information regarding the reason for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence and the date when full compliance was achieved is already adequately addressed on the docket in Inspection Report Nos. 50 454/97017 and 50 455/97017. However, ynu are required to submit a written statement of explanation pursuant to 10 CFR 2.201 if the description therein does not accurately reflect your corrective actions or your position in that case, or if you choose to respond, clearly mark your response as a " Reply to a Notice of Violation," and send it to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region lil, and a copy to the NRC Resident inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).

For Violation Number 2, pursuant to the provisions of 10 CFR 2.201, Commonwealth Edison is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region Ill, and a copy to the NRC Resident inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting the Notice of

, Violation (Notice). This reply should be clearly marked as a

  • Reply to a Notice of Violation" and should include for the violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. If an adequate reply is not received within the time specified in the Notica, an order may be issued to show cause why ti'c license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken.

Where good cause is shown, consideration will be given to extending the response time.

Because your response will be placed in the NRC Public Document Room (PDR), to the extent possible, it should not include any personal privacy, proprietary, or safeguards information so that it can be placed in the PDD without redaction. If personal privacy or proprietary information is necessary to provide an acceptable response, then please provide a bracketed copy of your response that identifies the information that should be protected and a redacted copy of your response that deletes such information. If you request withholding of such material, you muit specWically identify the portions of your response that you seek to have withheld and provide in detail the cases for your claim of withholding (e.g., explain why the disclosure of information will create an unwarranted invasinn of personal privacy or provide the infom1ation required by 10 CFR 2.790(b) to support a request for withholding confidential commercial or financial information), if safeguards information is necessary to provide an acceptable response, please provide the level of protection described in 10 CFR 73.21.
