NOTICE OF VIOLATION Commonwealth Edison Company Docket Nos. 50-454; 50-455 Byron Station Units 1 and 2 License Nos. NPF-37; NPF-66 As a result of the inspection conducted from August 16 through September 30, 1988, and in accordance with the "General Policy and Procedures for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1988), the following violation was identified:

10 CFR 50.55a(g) requires that licensees implement an inservice testing program for pumps and valves per the requirements of Section XI of the ASME Code unless specific relief has been granted by the Commission. Subsection IWP-4160 of Section XI of the ASME Code states in part that provision be made to duplicate the measurement points for those instruments which are position sensitive.

Pumps 1AF01PA, 2AF01PA, 2CC01PA, 2CC01PB, and 2SIO1PA are required to be tested in'accordance with the inservice testing program.

Contrary to the above, the licensee failed to explicitly identify the locations on pumps 1AF01PA, 2AF01PA, 2CC01PA, 2CC01P9, and 23IO1PA to be used for obtaining vibration measurements and did not submit a request for relief from the ASME Code to the Commission.

This is a Severity Level IV violation (Supplement I). (454/88016-01(ORP);

455/88015-02(DRP)).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, incitding for each violation: (1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further violations; and (3) the date when full compliance will be achieved.

Consideration may be given to extending your response time for good cause shown.
