NOTICE OF VIOLATION Commonwealth Edison Company Docket Nos. 50-454; 50-455 i

Byron Station, Units 1 and 2 Licenses No. NPF-37; NPF-66 During an NRC inspection conducted between June 30 and July 7,1997, one violation of NRC requirements was identified. In accordance with NUREG-1600, " General Statement of Policy and Procedure for NRC Enforcement Actions," the violation is listed below:

License Condition G to Facility Operating Licenses No. NPF-37 and NPF-66 requires that the licensee maintain in effect and fully implement all provisions of the Commission-approved Physical Security Plan, including Amendments made pursuant to the authority of 10 CFR 50.54(p).

Section 13.2.1 of the Byron Station Commission approved security plan states in part, "Each intrusion detection zone will have performance tests conducted annually. The tests I

will... confirm that the zone coverage and detection probability (90 percent probability with 95 percent confidence) are not reduced." Such confirmation is determined by attempts to l

penetrate the alarm zone. The number of successful alarms determine the number of j

required penetration attempts.

This is a Severity Level IV violation (Supplement 111).

The NRC has concluded that information regarding the reason for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence is already addressed in Section S2 of the attached Inspection Report. However, you are required to respond to the provisions of 10 CFR 2.201 if the description therein does not accurately reflect your corrective actions or your position. In that case, or if you choose to respond, clearly mark your response as a " reply to a Notice of Violation," and send it to the U. S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region Ill, and a copy to the NRC Resident inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).
