NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTK h pcensee: Entergy Operations, Inc. (EA 97-497)

River Bend Station Docket No. 50-458 Sublect: PROPOSED IMPOSITION OF civil PENALTY - $55,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $55,000 will be issued on or about December 23,1997, to Entergy Operations. Inc. This action is based on a Severity Level lli problem involving several violdons related to two separate events where tha licensee failed to ensure shutdown cooling systems were adequately maintained. The first violation involves a failure to meet techn! cal specification requirements when, in one event, the licensee inidvertantly transitioned from Reactor mode 4 to mode 3 for about 30 minutes and experie iced some boiling in the core. The remaining three violations involve failures to establish adequate procedures for op2 ration of shutdown cooling.

B cause this was not the first escalated enforcement action within 2 years, the staff considered whether credit was warranted for identification and corrective action. Credit was not warranted for Identification b:cause the violations were revealed by events and because there was industry experience and other information available to plant staff that should reasonably have caused actions that would have prevented tha violation. However, the NRC determined that Entergy is deserving cf Corrective Actions based on its prompt and comprehensive corrective actions.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule ofissuance and notification is:
