PROPOSED IMPOSITION OF CIVIL PENALTY - $100,000 This is to inform the Commission that a Notico of-Violation and Proposed Imposition of Civi1 Penalty will be issued on or about December 28, 1992 to Gulf Statos Utilities (Riverbond Station).
This action is based on 15 violations in which radiation survoya were not performed as required, radiation protection procedures were not follcwed as required, and contaminated _ material vaa disposed of by transfer to an unauthorized recipient.
Collectively, those violations are considered to represent a Severity Level III problem.
Mitigation for-good correctivo action was offset by escalation for poor prior performance in the q
health physics area.
However,.in oraer to convey the significance of this violation, the. civil ponalty has been escalated by 100 percent of the base civil penalty.
It should be noted that the licensoo has not been specifically informed of the enforcement action.
The schedule-of issuance and notification is:
Mailing of Notico December 28, 1992 Telephone Notification of Licensee December 28, 1992 The State of Louisiana will be notified.
The licensoo has thirty day s from.the date of tho Notice in which to respond.
Fo.tlowing NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed.by Order.
