PROPOSED. IMPOSITION OF CIVIL PENALTY - $75,000 This is tc inform the Comission that a Notice of Violation and Proposed -

Imposition of Civil Penalty in the amount of Seventy-Five Thousand Dollars

($75,000) will be is::ued on or about July 25, 1988 to the Carolina Power & Light Company. This action is based on three violations that occurred during a two month period. The first involved leaving a control rod fully withdrawn with the reactor protection system shorting links installed. The second involved t:12 failure to have required system alignments completed prior to a change in Operational Condition as required by the Technical Specifications.

The third involved the failure to maintain a proper shutdown cooling alignment wiiich resulted in an unplanned 35*F rise in reactor temperature. The escalation an_d mitigation factors of the Enforcement Policy were considered and in this case the base civil penalty was escalated 50 percent for poor past performance which included another inadvertent heatup event.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

Mailing of Notice July 25, 1988 Telephone Notification of Licensee July 25, 1988 The State of North Carolina will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
