PROPOSED-IMPOSITION OF CIVIL PENALTY
$225,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $225,000 will be issued on or about February 10, 1993 to Carolina Power &
Light Company.
This action is based on a significant breakdown in the licensee's corrective action program.
The licensee identified deficiencies with bolts required for the seismic adequacy of masonry walls in the emergency diesel generator building in 1987.
However, the deficiencies.were not evaluated until 1990, and assumptions used in that evaluation were inadequate.
The condition was not corrected until the NRC identified the problem in 1992, at which time the licensee shutdown the units.
The civil penalty was escalated for NRC identification, prior opportunity for the licensee to identify, poor past performance, and duration.
It should be noted that the licensee has not been specifically informed of the enforcement action.

. Telephone Notification of Licensee February 10, 1993-The State of North Carolina will be notified.
The licensee has thirty day s from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remicted, mitigated, or imposed by order.
