PROPOSED IMPO3ITION OF CIVIL PENALTY $62,500 This is to inform the Cosmiission that a Notice of Violation and Proposed l Imposition of Civil Penalty in the amount of $62,500 will be issued on or about t

August 30, 1990 to the Carolina Power & Light Company (Brunswick). This action is based on an event that occurred on-July 5,1990. During work on the Unit I traversing incore probe (TIP) plant technicians received unplanned radiation R exposures from an activated TIP having a. radiation dose. rate of approximately 1000 rem per hour on contact. While no regulatory radiation exposure limits '

were violated, it was determined that a substantial potential for overexposures existed. The base civil penalty of $50,000 was-escalated 25 percent after partially off-setting the escalation for prior notice of similar events by mitigation-for identification and reporting as well as corrective actions.

It should be noteo' that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

Mailing of Notice August 30, 1990 Telephone Notification of Licensee . August 30, 1990 The State of North Carolina will be notified.

The licensee has thirty days from the date of the' Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
