IMPOSITION OF CIVIL PENALTY - $25,000 By EN 88-61 dated July 20, 1988 the Commission was notified of the intent of OE to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Seventy-Five Thousand Dollars ($75,000) to Carolina Power and Light Company. This action was based on three violations involving failures to control operational activities.
The licensee responded to the Notice in letters dated August 24 and September 26, 1988 and acknowledged the violation, paid the base civil penalty but contested the escalation of the civil penalty. After careful consideration of the licensee s responses, the staff has concluded that the escalation of the base civil penalty was appropriate.
Accordingly, an Order Imposing Civil Penalty in the arount of $25,000 has beer, issued today. Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearing.
