PROPOSED IMPOSITION OF CIVIL PENALTY - $120,000 This is to inform the Commission that a Notice of Violation an'd Proposed Imposition of Civil Penalty in the amount of One Hundred and Twenty Thousand Dollars will be issued on or about July 15, 1982 to Carolina Power and Light Company. This action is based on unsatisfactory performance of operators at the Brunswick, Unit 1 facility resulting in violations involving the failure over several days to recognize a failed safety related water level instrument and to fully implement a required action statement once the failure was recognized.

It should be noted that the licensee has not been specifically informed of the enforcement action. The Regional Administrator has been authorized by the Director of Inspection and Enforcement to sign this action. The schedule of issuance and notification is:

Mailing of Notice July 15,1982 Telephone of Notification July 15,1982 A news release has been prepared and will be issued about the time the licensee receives the Notice. The State of North Carolina will be notified.

The licensee has 30 days from the date of the Notice in which to respond.

Following NRC Staff evaluation of the response, the civil penalty may be remitted, mitigated or imposed by Order.
