0FFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Carolina Power and Light Company (EA 87-165)
Brunswick Units 1 and 2 Docket Nos. 50-324 and 50-325
Subject:
PROPOSED IMPOSITION OF CIVIL PENALTY - $50,000 This is to inform the Comission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amoult of Fifty Thousand Dollars ($50,000) will be issued on or about May 5, 1988 to Carolina Power and Light Company.
This action is based on violations of equipment qualification requirements of 10 CFR 50.49.
In accordance with the "ifodified Enforcement Policy Relating to 10 CFR 50.49," contained in Generic Letter 88-07 the violations have been categorized as a Category B problem. The escalation and mitigation factors of the modified enforcement policy were considered and because of the licensee's identification and prompt reporting.of seme of the deficiencies, best efforts to be in compliance within the E0 deadline, and initiation of vigorous and extensive corrective.~ actions, the base civil penalty has been reduced to the allowable minimum.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
Mailing of Notice May 5, 1988 Telephone Notification cf Licensee May 5, 1988 The State of North Carolina will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
